<br />.t <br /> <br />:. <br /> <br />~. <br /> <br />RESOLUTION No. 99-059 <br /> <br />J~ <br /> <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVAL OF A MINOR SUBDIVISION OF CERTAIN <br />PROPERTY WITHIN THE CITY OF NEW BRIGHTON AT 1390 SILVER LAKE ROAD <br /> <br />WHEREAS, the City of New Brighton has been requested to subdivide certain property in <br />the City of New Brighton described as follows: <br /> <br />See Attached Exhibit "A" <br /> <br />WHEREAS, State Statutes require that if such property is located in municipalities that have <br />adopted a platting ordinance, approval of the municipality must be obtained before such subdivisions <br />can be filed; and <br /> <br />WHEREAS, Section 26-24 of the New Brighton City Code provides for subdivision of property <br />without platting if certain criteria can be met. <br /> <br />Now, THEREFORE BE IT RESOLVED, the City Council of the City of New Brighton hereby approves <br />the subdivision of the above-described property into parcels described as follows: <br /> <br />See Attached Exhibit "B" <br /> <br />BE IT FURTHER RESOLVED, the City Council of the City of New Brighton approves PL-252, subject <br />to the following conditions: <br /> <br />1. A grading and drainage plan must be submitted with a building permit application to ensure that <br />any grading associated with the construction of the two homes shall not have any negative <br />impacts on adjacent properties. <br />2. There shall be no building encroachment into the drainage easement. <br />3. Shared driveway access shall be off of silver lake road. <br />4. The applicant shall work with the City's Engineering Department in regard to utility hook ups. <br />5. A twenty-foot utility easement shall be centered over sewer line coming in off of 14th Street. <br />6. Submittal of a shared driveway access easement/agreement that would hold the lot owners of <br />Lot B & C responsible for maintenance. Said agreement shall be subject to review and approval <br />of the City Attorney. <br />7. Park Dedication of$750 per lot for each of the two new lots shall be paid at the time of building <br />permit application. <br />
