<br />~ <br /> <br />~ <br /> <br />BE IT FURTHER RESOLVED, that Resolution # 98-071 is hereby rescinded; and <br /> <br />BE IT FURTHER RESOLVED, the application PL-246 is hereby approved subject to the following <br />conditions: <br /> <br />j( <br /> <br />1. Approval of a permit by the Rice Creek Watershed District (RCWD). <br />2. The proposed roadway must be constructed to a 28-foot wide paved surface with a 42-foot <br />paved radius for the cul-de-sac. <br />3. The mature White Oaks along the eastern lot line are not disturbed, and a minimum setback for <br />driveways and all structures be 35-feet from the east property line for Lot 9. <br />4. The 26-inch diameter Oak Tree on Lot 7 be saved, and be fenced during construction of the <br />home on Lot 7 to protect it from damage. <br />5. Each new home must be constructed above the 932 elevation. <br />6. The Final Plat must include a drainage and utility easement over the drainage area on Lot 1, <br />and over the Stony Lake Wetland. <br />7. Review and approval of the Final Grading Plan by the City Engineer. <br />8. Installation of a storm sewer overflow in 23rd Avenue to protect lakeshore properties from <br />flooding. <br />9. Each new home proposed for constructed within the subdivision must submit a grading plan <br />with their application for a building permit. Said grading plans must be consistent with the <br />overall grading plan approved as part of the Final Plat. <br />10. The proposed cul-de-sac be named 16th Terrace Northwest, and be designated as such on the <br />Final Plat. <br />11. The developer shall be responsible to dedicate fees in lieu of land for Park Dedication in the <br />amount of$750 per lot, fees shall be due at the time of Building Permit application. <br />12. The Council makes the finding that an Environmental Assessment Worksheet is not required <br />as part ofthis project. <br />13. A Boulevard Landscape Plan shall be submitted with the Final Plat application. Said Plan shal <br />be subject to review and approval of the City Forester. <br />14. Covenants shall be established on each lot within Stony Lake Estates requiring that two (2), <br />two- inch diameter trees be planted on each lot. <br />15. Covenants shall be established on each lot within Stony Lake Estates prohibiting any alteratim <br />of the grading and drainage without review and approval of the City Engineer. <br />16.
