<br />'......, <br /> <br />... <br /> <br />.' -- <br /> <br />'.,y <br /> <br />RESOLUTION No. 99-052 <br /> <br />-, <br /> <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT APPROVING A MINOR SUBDIVISION OF CERTAIN PROPERTY <br />WITHIN THE CITY OF NEW BRIGHTON AT201 5TH AVENUE S.W. <br /> <br />~ ~ <br /> <br />WHEREAS, the City of New Brighton has been requested to subdivide certain property in the City <br />of New Brighton described as follows: <br /> <br />See Attached Exhibit "A" <br /> <br />WHEREAS, State Statutes require that if such property is located in municipalities that have <br />adopted a platting ordinance, approval of the municipality must be obtained before such subdivisions <br />can be filed; and <br /> <br />WHEREAS, Section 26-24 of the New Brighton City Code provides for subdivision of property <br />without platting if certain criteria can be met. <br /> <br />Now, THEREFORE BE IT RESOLVED, the City Council ofthe City of New Brighton approves the <br />subdivision ofthe above-described property into parcels described as follows: <br /> <br />See Attached Exhibit "B" <br /> <br />BE IT FURTIfER RESOLVED, the City Council approves PL-251, subject to the following conditions: <br /> <br />1. There shall be a driveway maintenance agreement established between Paroel A and Parcel B, <br />subject to review and approval of the City Attorney. <br />2. There shall be no building encroachment into the 30-foot Ingress & Egress (driveway) <br />easement on Parcel A. <br />3. No parking shall be allowed within the 30-foot Ingress & Egress (driveway) easement on <br />Parcel A. <br />4. All junk, debris and construction materials shall be removed from proposed Parcel B. <br />5. Perimeter curbing shall be installed in the locations where no curbing exists on Parcel A. <br />6. Any areas on Parcel A utilized for off-street parking and drive-aisles shall be paved with a <br />bituminous surface. <br />7. Grading and drainage associated with the development of Parcel B shall not have any regative <br />impacts on adjacent properties and shall be subject to review and approval of the City <br />Engineer. <br />8. The development of Parcel B shall require the submittal of a Utility Plan showing individual <br />lot hook up of sewer and water for Parcel B. Said plans shall be subject to review and approval <br />of the City Engineer. <br />
