<br />RESOLUTION No. 99-043 <br /> <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVAL OF A MINOR SUBDIVISION OF CERTAIN <br />PROPERTY WI1HIN THE CITY OF NEW BRIGHTON ON 16TH AVENUE SW (NORTH OF SILVER LANE AND <br />SOUTH OF 3RD STREET SW, NORTH OF 336 161H AVENUE SW). <br /> <br />WHEREAS, the City of New Brighton has been requested to subdivide certain property in the City <br />, of New Brighton described as follows: <br /> <br />See Attached Exhibit "A" <br /> <br />WHEREAS, State Statutes require that if such property is located in municipalities that have <br />adopted a platting ordinance, approval of the municipality must be obtained before such subdivisions <br />can be filed; and <br /> <br />WHEREAS, Section 26-24 of the New Brighton City Code provides for subdivision of property <br />without platting if certain criteria can be met. <br /> <br />NOW, 1HEREFORE BE IT RESOLVED, the City Council of the City of New Brighton hereby <br />approves the subdivision of the above-described property into parcels described as follows: <br /> <br />See Attached Exhibit "B" <br /> <br />" <br />il <br /> <br />BE IT FURTHER RESOLVED, the City Council of the City of New Brighton recommends approval of <br />PL-250, subject to the following conditions: <br /> <br />1. A grading and drainage plan must be submitted with a building permit application to ensure that al}' <br />grading associated with the construction of the two homes shall not have any negative impacts on <br />adjacent properties. <br />2. There shall be no building encroachment into the drainage easement. <br />3.
