RESOLUTION No. 09-084 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />)N MAKING FINDINGS OF FACT AND APPROVING A PARTIAL EASEMENT VACATION. <br />an application has been made by Citizen's State Bank for the partial vacation of a <br />and utility easement located on 1820 Old Highway 8 NW, dedicated on the plat of <br />'OOD POINTE OF NEW BRIGHTON. <br />,s, the procedural history of the application is as follows: <br />The applicant submitted a Vacation application on November 25, 2009. <br />Public hearing notices for the vacation were published in the November 25, 2009 and <br />December 2, 2009 editions of the New Brighton Bulletin. <br />A public hearing was held on December 8, 2009. <br />The City Council considered the Vacation request on December 8, 2009, <br />WHEIR I As, the City Council makes the following Findings of Fact with respect to EV2009-001: <br />1. The property located at 1820 Old Highway 8 NW is legally described as follows: <br />Parcel A <br />All that part of the east 150 feet of the south 240 feet of the Southeast Quarter of Section <br />17, Township 30, Range 23, which lies westerly of the following described line: <br />Beginning on the south line of said Section 17 at a point 100 feet west of the <br />Southeast Quarter corner thereof; then run northerlyto a point 200 feet north of <br />the south line and 70 feet west of the east line of said Section 17; thence run north <br />parallel with said east line of said Section 17 for 500 feet and there terminating. <br />Excepting therefrom the south 40 feet thereof. <br />Also the west 70 feet of the east 220 feet of the south 240 feet of the Southeast Quarter of <br />Section 17, Township 30, Range 23, Ramsey County, Minnesota. <br />Parcel B <br />Outlot A, APPLEWOOD POINTE OF NEW BRIGHTON, Ramsey County, Minnesota. <br />A drainage and utility easement was dedicated over a portion of Outlot A as part of the <br />plat of APPLEWOOD POINTE OF NEW BRIGHTON. <br />Upon development of 1820 Old Highway 8 NW, a stairwell structure was constructed on <br />top of the dedicated drainage and utility easement encumbering 299 square feet of the <br />easement. <br />411 The proposed portion of the easement to be vacated is legally described as follows: <br />IL\REPORTS\2009\Community Development\12-8-2009\EV2009-001 (Citizen's State Bank) - RESOLUTION.doc <br />
