07 <br />RESOLUTION NO. <br />09-068 <br />STATE OF MINNESO'T'A <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />UTION RE -APPROVING A SITE PLAN AND SPECIAL USE PERMIT APPROVED PER RESOLUTIONS <br />1 AND 08-055. <br />THE AS, an application has been made by NAI Architects, Inc. on behalf of Champps <br />Res aurant at 2397 Palmer Drive to allow for construction of an outdoor dining patio at the north <br />end f the existing building, and <br />41EAS, the procedural history of the application is as follows: <br />1. 1 le City Council adopted Resolution 07-031 on April 26, 2007 approving a Site Plan and <br />ecial Use Permit for the property. <br />2. a approvals per Resolution 07-031 expired on October 26, 2007. <br />3. a applicant submitted for re -approval of the Site Plan and Special Use Permit on April 18, <br />4. irsuant to published and mailed notice, the Planning Commission held a public hearing on <br />ay 20, 2008 to consider re -approval of the Site Plan and Special Use Permit. <br />5. ie Planning Commission found that because the request is identical to the 2007 request, the <br />nding of Fact noted in Resolution 07-031 remain valid. <br />6.e Planning Commission and City Council re -approved the requests consistent with <br />solution 07-031 by adopting Resolution 08-055. <br />7. fe approvals per Resolution 08-055 expired on November 27, 2008. <br />8. 71111 a applicant submitted for re -approval of the Site Plan and Special Use Permit on <br />tember 21, 2009. <br />9.a Site Plan and Special Use Permit submitted are nearly identical to the project approved <br />in 2007 and 2008 except that the outdoor dining patio was reduced in size by approximately <br />in width. <br />10.11 suant to published and mailed notice, the Planning Commission held a public hearing on <br />tober 20, 2009 to consider re -approval of the Site Plan and Special Use Permit. <br />11. Tie Planning Commission recommended approval consistent with Resolutions 07-031 and <br />-055. <br />12.
