ObOf Report Number 10-023
NEW Agenda Section VI -2
BRKIn"14 Council Meeting Date January 26, 2010
the city that works for you
i REQUEST FOR COUNCIL CONSIDERATION
ITEM DESCRIPTION: Consideration of a Special Use Permit to allow installation of
telecommunications antenna on an existing electrical transmission tower at a height of 120' at 2172 Old
Highway 8 NW.
DEPARTMENT HEAD'S APPROVAL: Grant Fernelius, Community Development Director
CITY MANAGER'S APPROVAL:
No comments to supplement this report C./ Comments attached
15.99 Deadline: December 29, 2009 ext9d6edfo February 27, 2010
Recommendation: Adopt the attached Resolution approving the request as submitted.
Legislative History: November 17, 2009: The Planning Commission held a public hearing and
considered the request. No public testimony was given. The Commission voted unanimously to
recommend approval as submitted and for the approval to be good for 12 months.
Financial Impact: None
Explanation: The applicant works for Buell Consulting and is acting on behalf of Clearwire
Communications. The Special Use Permit request would allow for installation of three panel antennas
and three microwave dishes on the existing Xcel Energy Transmission Tower at 2172 Old Highway 8
NW at a height of 120'. Also included in the request is the ability to use ground space to place the
necessary equipment to operate the antennas. The antennas would be painted to match the tower and
expected installation would be the summer of 2010.
This is the only request by Clearwire involving installation of antennas on private property. The
applicant has obtained landowner consent for the ground space and is currently working with Xcel
Energy on signing a Master Lease Agreement that would allow Clearwire to install equipment on other
Xcel Energy -owned poles/towers. However, Clearwire should have to come back to the City for land
use approval on any other sites. As an aside, this site already accommodates Sprint with tower and
ground space.
Staff has provided a written analysis of how this request complies with the Special Use Permit standards
of Section 4-600 and 8-130. In summary, staff finds all criteria have been met and would recommend
approval.
The following are attached for reference: A) Resolution, B) 60 day extension letter, C) Planning Report
& Exhibits dated 11/9/2009.
Costs and Funding: Not applicable
C4 U*Wt.XtA ._
Janice Gundlach
City Planner
