Consideration ofa partial vacation of a drainage and utility easement affecting property located at <br />1820 Old Highway NW. Report No. 09-305. Resolution No. 09-084. <br />City plannerianiceGuldlach explained the applicant, who is acting on behalf of Citizen's <br />State Bank (the property is in foreclosure for the second time), is requesting a partial <br />vacation of a drainage and utility easement existing along the northern property boundary <br />of 1820 Old Highway 8 NW. The portion of the easement to be vacated is approximately <br />299 SF. The reason for the vacation is that the underground parking structure's <br />secondary exit stairwell shed is lying partially within the dedicated easement. The <br />easement exists to accommodate a shared stormwater detention area for use by this <br />property (1820 Old Highway 8 NW) and 1900 Rush Lake Trail (Applewood Pointe). <br />Public Works has confirmed the function of the stormwater detention area will not be <br />negatively impacted by the vacation. <br />Mayor Larson opened the Public Hearing at 7:24 pm <br />Motion by CouncOmember Phillips, seconded by CouncBmember Burg to close the public <br />hearing„ <br />5 Ayes, 0 Nays — Motion Carried <br />Motion by Councomember Phillips, seconded by Councirnember Buig to hold the public <br />hearing. Public Hearing for proposed 2010 Lake Diane Improvements. <br />Report No. 09-306. <br />City Manger Lotter explained this in an annual project. City Engineer Grant Wyffels reported <br />this taxing district was established in 1984. Notice was sent to all 24 properties, three <br />attended a meeting November 23, 2009.
