PLANNING COMMISSION PROCEEDINGS <br />Regular Meeting — January 19, 2010 7:00 p.m. <br />Present: Commissioners James Alvey, Steve Danger, Bruce Howard, Verne McPherson, Norm <br />Schiferl, and Paul Zisla. <br />Absent: <br />Also Present: David Phillips, Council Member, and Janice Gundlach, City Planner. <br />Agenda Review: Agenda was approved. <br />Election of Temporary Chair for Meeting: <br />Motion by Alvey, Second by Schiferl to Elect Bruce Howard as the Temporary Chair. <br />6 ayes, 0 nays. MOTION APPROVED. <br />Minutes: Minutes for November 17, 2009 were presented and approved. <br />Council Action: Council Member Phillips stated it was announced at the last Council meeting that the <br />City has an additional $110,000.00 deficit. Due to this issue the first budget work session will be held <br />• this February. Council is looking for the Planning Commission to continue to review the Zoning <br />Ordinance. Phillips announced that there are openings on the Planning, Public Safety, and Park and <br />Recreation Commissions and encourage the public to apply. <br />Public Hearing: 1820 Old Highway 8 NW <br />The item for this Public Hearing has been withdrawn by the applicant. <br />Danger inquired if staff could clarify why the application was pulled. Gundlach replied that the bank, <br />which owns this property, was in discussions with a possible tenant and the tenant has since withdrawn <br />their interest in the property. <br />Zisla asked why the applicant would need a variance for a tenant. Gundlach replied the building had <br />been approved as a mixed use with office on the first three floors, and two residential condominiums on <br />the forth floor. The bank has had difficulty finding interest in the two residential units and was seeking <br />approval to convert them into office space. However, office space needs to meet a higher parking ratio <br />requirement than residential and thus were asking for a parking variance. Gundlach added that staff has <br />worked with the bank to steer them away from a variance and believes there are options to convert that <br />space without asking for a variance. Zisla asked staff to clarify what the options would be. Gundlach <br />replied that the building currently has a special use permit for height, and for mixed use. If the applicant <br />should decide not to use the top floor for residential the mix use special permit would not be valid, <br />however the special use permit for the fourth floor would still be in effect. Staff has been working with <br />• the City Attorney on some possible conditions for the fourth floor based on the 4 1 floor height Special <br />Use. The recommendations so far have included using the fourth floor for conference or storage rooms <br />only or trading the same square footage for another location within the building that would not draw <br />demand on parking. <br />
