9 LEASE AGREEMENT <br />THIS LEASE AGREEMENT, made and entered into as of this day of <br />, 2010, by and between the City of New Brighton, a Minnesota municipal <br />corporation, whose address is 803 Old Highway Eight Northwest, New Brighton, Minnesota <br />55112 (hereinafter referred to as "Landlord") and Ramsey County, a political subdivision of the <br />State of Minnesota and Home Rule Charter County whose address is 15 West K61Iogg Blvd., St. <br />Paul, MN 55102, (hereinafter referred to as "Tenant".) <br />WITNESSETH: <br />ARTICLE I - GRANT AND TERM <br />1.1 LEASED SPACE. In consideration of the rents, covenants and agreements herein <br />reserved and contained as the ,part of Tenant to be performed, Landlord does hereby lease to <br />Tenant Room 202 (635.5 square feet) in the Family Service Center of New Brighton located at <br />400 Tenth Street Northwest, New Brighton, Minnesota, hereto (hereinafter referred to as the <br />"Leased Space".) A drawing of the. Leased Space is attached hereto as Attachment One. <br />1.2 INITIAL IMPROVEMENTS. Landlord will prepare the Leased Space in accordance <br />with the specifications indicated on Exhibit A. is herein referred to as ``Initial Improvements". <br />Landlord will commence such work promptly upon the execution of this lease. Landlord will <br />install heating, ventilating and air conditioning equipment, ducts, outlets and controls fully <br />adequate.. to maintain the environmental comfort conditions required under this lease throughout <br />the Leased Space. The Initial Improvements shall be in compliance with applicable building <br />codes and the Americans with Disabilities Act. The Initial Improvements shall be subject to. <br />acceptance by Tenant, which acceptance will not be unreasonably withheld. <br />1.3 TERM. The term of this Lease and Tenant's obligation to pay rent hereunder <br />shall commence on May 1, 2010, ("Commencement Date") and shall run until April 30, 2025. <br />("Term"). <br />Notwithstanding the foregoing, if the Leased Space, on the Commencement Date, is not ready <br />for occupancy by the Tenant because the Initial Improvements have not been completed and <br />accepted by Tenant, or by any reason of any building operations, repair, or remodeling to be done <br />by the Landlord, the Term shall be automatically extended so as to include the full number of <br />years of the Term, and the Commencement Date shall be the date the Leased Space is completed <br />and accepted by Tenant. - <br />1.4 USE OF COMMON AREAS. Tenant shall have the non-exclusive right to use <br />the entry ways, elevators, stairs, hallways, and restrooms of the Family Service Center. <br />Employees of the Tenant shall have the non-exclusive right to use the parking areas. No more <br />than 25 guests or invitees of the Tenant shall be permitted to use the parking areas except by <br />approval of the Landlord. Use of the public areas of the.Family Service Center shall be subject <br />to such reasonable rules and regulations for use of such areas as may -be established from time to <br />time by the Landlord. Landlord will not install or maintain any vending machines whatsoever <br />
