January 26,
Motion by Councilmember Phillips, seconded by Councilmember Samuelson to adopt
the attached Resolution approving the Special Use Permit and authorize the City
Manager and Mayor to enter into a Tower Lease Agreement between the City of New
Brighton and Clear Wireless LLC, as approved by the City Attorney, for property
located at 660 5`h ST SW.
5 Ayes, 0 Nays -Motion Carried
2. Consideration of Special Use Permit and Lease Agreement to allow replacement of an
existing 70' light pole with a 100' monopole to include installation of six antennas at
Freedom Park, 2121 14th Street NW. Report No. 10-029. Resolution No. 10-013.
City Planner Janice Gundlach explained the Special Use Permit would allow for an existing 70'
light pole to be replaced with a 100' light pole that would support telecommunications
equipment. The equipment includes a utility cabinet roughly the size of a small
refrigerator. The expected installation would be the summer of 2010. Staff has
informed the applicant that these types of requests in parks have not been approved
previously (exception being Creekview Park). One resident attended a neighborhood
meeting, and was not opposed to the request. Lastly, with the additional 30' of height
added to the pole, there may be a possibility for future co -location with another
telecommunications provider. It should be noted, Clearwire will retain ownership of the pole
and the ability to generate lease revenue from future co -locators. The City's ability to
generate revenue through co -location is by leasing ground space. The Planning
Commission voted unanimously to recommended approval. The lease agreement with
Clearwire is for a 20 -year period with an initial 5 -year term and three 5 -year renewal
periods. The rent payment is $17,475 annually, prorated for the first partial year of 2010
commencing upon the date Clearwire starts construction or November 1, 2010, whichever
occurs first. In subsequence years the rent is due on January 1st and will be annually adjusted
upward by the Consumer Price Index or 4%, whichever is greater. Councilmember Phillips
expressed concern with the underground electric going though the basketball court, and suggested moving
the power to the perimeter ofthe croup. Ms Gndlach reported Clearwireishoping to be up and ruining
summer 2010. Councilmenbe Samuelson commented that it would be beneficial to allow appropriate
-0
Motion by Councilmember Bauman, seconded by Councilmember Burg to adopt the
attached Resolution approving the Special Use Pernik subject to conditions, and to authorize the
City Manager and Mayor to enter into a Tower Lease Agreement between the City of New Brighton
and Clear wireless LLC, as approved by the City Attorney, for property located at 212114th Street
Nw.
unahnenbcr Phillips added the following amendment:
IFthe requirement that within two years if landscaping is necessary, the amount up to that listed on the
lan could be required.
5 Ayes, 0 Nays -Motion Carried
2 .
