Consideration of Request by Bremer Bank to Amend the Amended and <br />Restated Contract for Private Redevelopment with New Brighton Commons, <br />LLC and Subordinate City's Interest in said Agreement to a New First <br />Mortgage. Report No. 10-075. <br />City Planner Janice Gundlach explained New Brighton Commons, LLC (Ryan Companies <br />US, Inc.) has notified the City that it intends to sell the building at 200 5th Avenue NW. The <br />prospective purchaser, NB Commons, LLC is seeking financing from Bremer Bank for the <br />purchase of the property. As part of this process, the Lender has requested two things from <br />the City: Subordination of the City's interest in the redevelopment contract to a new first <br />mortgage; and an amendment to the existing redevelopment contract. <br />Councilmember Phillips expressed concern with the insurance language, making the City's <br />interest subordinate in the event of a major catastrophe. Councilmember Bauman requested <br />clarification on the names of the of the parties involved, Ms. Gundlach stated to her <br />knowledge the companies are not affiliated.
