That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />That adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br />That the special use shall in all other respects conform to the applicable regulations of the <br />district in which it is located. <br />7. 1 he Planning Commission and City Council found all Special Use Permit criteria of Sections <br />040 (3) (B) and Section 8-130 to be met due to the following: <br />a. The exterior materials and roof lines of the entryway will compliment the existing home. <br />8. The proposed entryway will have a residential appearance. <br />The proposed entryway will not be detrimental to the neighborhood. <br />8. a applicant proposes to make improvements to the property at 2738 17'' Terrace NW <br />here a nonconforming 4' side yard setback exists when 5' is normally required. <br />9. a Planning Commission and City Council considered the proposed Nonconforming Use <br />ermit in accordance with Zoning Code Section 8-460, which regulates Type 4 <br />onconformities and requires one of the following criteria to be met: <br />The total number of nonconformities is reduced. <br />The impact of any nonconformity upon adjacent premises is reduced to the greatest <br />practical extent. <br />The extent of any nonconformity is reduced where practical. <br />10.
