ORDINANCE NO.790 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />A ZONING CODE AMENDMENT RELATING TO <br />AN UPDATED AND AMENDED <br />FLOODPLAN MANGEMENT ORDINANCE <br />REFLECTING UPDATED FLOOD INSURANCE RATE MAPS <br />AND OTHER FEMA MANDATED UPDATES <br />CITY COUNCIL OF THE CITY OF NEW BRIGHTON ORDAINS that the New Brighton <br />of Ordinance is amended by amending City Zoning Code Chapter 10 as follows: <br />Flood Plain Management <br />1. General Conditions, §§ 10-010-40-130 <br />Article 1. General Conditions <br />Statutory Authorization, Findings of Fact, and Purpose. <br />(1) #atutory Authorization. The legislature of the State of Minnesota has, in Minnesota Statutes, Chapter <br />103 delegated responsibility to local government units to adopt regulations designed to minimize flood <br />loss . This Chapter prescribes the regulations adopted by the City of New Brighton. <br />(2) 'ndings of Fact. <br />A. The flood hazard areas of New Brighton, Minnesota, are subject to periodic inundation that <br />results in potential loss of life, loss of property, health and safety hazards, disruption of commerce <br />and governmental services, extraordinary public expenditures or flood protection and relief, and <br />impairment of the tax base, all of which adversely affect the public health, safety, and general <br />welfare. <br />B. This Chapter is based upon a reasonable method of analyzing flood hazards that is consistent <br />with the standards established by the Minnesota Department of Natural Resources. <br />C. This Chapter is adopted to comply with the rules and regulations of the National Flood <br />Insurance Program codified as 44 Code of Federal Regulations Parts 59 — 78, as amended so as <br />to maintain the community's eligibility in the National Flood Insurance Program. <br />N. It is the purpose of this Chapter to promote the public health, safety, and general welfare and <br />to minimize those losses described in Section 10-010(2) A by the provisions contained herein. <br />(Ord.
