RESOLUTION <br />PLANNING COMMISSION <br />CRY OFNEW BRIGHTON <br />RESOLUTION MAKING FMDPoGs OF FACE AND RECOMMENDING APPROVAL OF A NONC omsux NG <br />USE PERMR. <br />WHEREAs, an application has been made Bethel College to permit demolition of a detached garage <br />structure, thereby reducing the amount of covered making at 691-7991° AVE NW, and <br />WHEREAS, the procedural history of the application is AS follows: <br />1. An application for alloncomrming Use Permit was received on April 9,2010. <br />2. The Planning Communion, Pursuant to a mailed oorice to property owners within 350', held <br />a public hearing on May 18, 2010 and all present were given a chance to freely spear: at the <br />hearing. <br />3. The Planning Commission recommended approval on May 18, 2010 subject W conditions. <br />WHEISEAS, the Planing Commission makes the following Findings of Fact with respect to the <br />Nonconforming Use Permit (NC201MM): <br />1. The property is zond R -3A, High Density Residential. <br />2. The property is guided in the Comprehensive Plan for High Density Residential. <br />3. The applicant would like In remove the northerly detached image structure, eliminating 19 <br />covered parking stalls, and re -striping surface Stalls. <br />4. The medicate maintains the garage is in need of remand so AS to increase surf Peking, <br />decrease on -street parking, And in increase safety and security esus on site. <br />5. The garage demolifion will provide for a net increase of 17 surface parkins malls on site. <br />6. The existing nonconfOlanities are as follows: <br />a. Fewer off-street parking stalls than required by code. <br />b. Fewer covered Parking stalls then required by code. <br />c. Frons, side, andrearyard Parking lotsetbacks less then required by code. <br />7. The Planning Commision considered the proposed Nonconforming Use Pendt in <br />accordance with Zoning Cade Section 8-060, which identifies Type 4 no ssurboaraities, and <br />allows them to continue when one or more of the following criteria ane met: <br />a The total member ofrevcoofomuties is reducd. <br />b. The import of my nonconformity, upon adjacent premises is reduced to the greatest <br />practical extent. <br />c. The extent ofmy mn nformityis reduced where padcal. <br />8. The Planning Commissiondetermi d the criteria of Section 84N have been met due to the <br />following: <br />a The not increase of on-site surface parking will eliminate Use nonconformity related to <br />fewer off-street parking stalls Oen required by code. <br />b.
