Report Number 10-142 <br />Agenda Section "11.1 <br />he day nae uwxsf ow Council Meeaog Date June 8, 2010 <br />REQUEST FOR COUNCIL CONSIDERATION <br />ITEM DESCRIPTION: Mlm tent requests approval of a SNaal Use Permit m pend[ op on of <br />a motorized scooter sales and repair boniness, including outdoor display of 5-7 scooters n my given <br />Recommendation: Adopt the Roadatior�p¢proving the Special Use Permit subject to the following <br />conditions: <br />I. All sales and leasing are limited to motonzed, gas operated moped accurate ranging from <br />50cc to 300ce, including elecGc and gas hybnds. <br />2. No more then 7 scooters may be displayed outdoors at my given time and are conf d to no <br />re Wan 3 padang spaces within the finding lot located on the east side of the building. <br />All scooters displayed outdoors most be in good repair. No signs, Rags, streamers, banners, <br />or the like may be displayed outdoors (exception is permanent wall sign). <br />3. All scooters most be smorl indoors during non -business hours. <br />4. All repair rennins of the business most be conducted entirely indoors. <br />5. The Building Official must conduct an inspection he ensure all Building Code requirements <br />have been met prior to opening for business. <br />Legislative History: May 18, 2010: The Planning Commission considcced the request and held a <br />public hearing. No public testimony was given. The Commission briefly discussed the request without <br />the applicant being presata and ressommaindial transitions approval consistent with the staff <br />recommendation. The Commission mated that the applicant should be present for City Council <br />consideration. <br />Financial Impact: None <br />Explanation: The applicant is requesting a Special Use Permit No peanut operation of a notarized <br />s000tm sale, lease, and repair business at 833 3'" ST SW, Suite Wb (for motherly suite)- Any type of <br />vehicle sales requires reviov and approval of a Special Use Permit within the industrial district. The <br />Name space is approximately 2,400 Sit. The applicant's proposed business includes leasing and the sale <br />of new and used gas operated, electric, arm hybrid moped scooters noting from 50ce to 300ce in size. <br />Seasonally, up to 7 scooters would be displayed outdoors during business hours. Lastly, the applicant <br />will provide scooter repair services on site and during non -business hours and nothing will be stored <br />outdoors. <br />Staff considered the Special Use Permit standards including the general bough, safety and welfare <br />standards of Zmtinng Cede Se:tion 8-130. A full analysis is provided in the attached Planning Refund <br />Staff finds that with conditions, the proposed use will meet all special use criteria. <br />
