RESOLUTION NO. <br />STATE OF MINNE$pFA <br />COUNTY OF RAAISEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAEMG FRNMGs OF FACT ANO APPROVAL OF A SPECIAL USE PEftMR. <br />WR@REAs, an application has been made by Allen Lenz to permit operation of a motorint <br />scooter business consisting of Few and used sales, leasing, and repair of scooters between 5000 <br />ab 3000; at the existing building located at 833 3" ST SW, Suite k6, and <br />WBEEEAS, the procedural bistory of the application is as follows: <br />1. An application for a Special Use Permit was received on April 28, 2010. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on May 18, 2010 and all present were given a chance to Gcely spook at the hearing <br />3. The Planning Commission voted to recommend approval on May 18, 2010 subject to <br />conditions. <br />4. The City Council considered me request on June 8, 2010. <br />Wimusm, the Planning Commission and City Council make the fethrwag Findings of Fac[ with <br />respect to the Special Use Permit (SP2010-004): <br />1. The property is zoned h I, Light Industrial. <br />2. The property is guided in the Comprehensive Plan for Light Industrial. <br />3. The applicant has proposed to operate a motorized scooter business consisting of new and <br />used Sales, leasing, and repair of scooter between 50cc and 30000. <br />4. Zoning Code Sections 5240 (6) & (n and 6-050 (2) indicate a Special Use Permit is <br />requved for an severance services and sales use. <br />5. For the purposes of this renew, scooter is being considered an sutmnabile. <br />6. The Planning Commission and City Council reviewed the proposal in with the <br />following Special Use Permit conditions Of Zoning Code Section 8-130: <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to orendanger the public health, safely, morals, comfort or general welfare. <br />b. That the special use will not he injurious to the use and joymrnt of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values wddn the neighborhood. <br />c. That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the mrrowding property for uses permitted in the <br />district. <br />d. That adequate utilities, access mads, drainage andlor necessary facilities have been or are <br />being provided. <br />e. That the special use shall in all other respects conform to the applicable regulations of the <br />district in which it is lacteal. <br />8. The Plasu ng Commission and City Council found all Special Use Permit entente of Section <br />8-130 to be met due to the fallowing: <br />a. Adequate padting will be provided on site. <br />b.
