11F.60LUTION <br />PLANNING COMMISSION <br />CITU OFNKw BwdGDrON <br />BESOLmRON MAKING FINDINGS OF FALT AND RECAMMENOND APPROVAL OF A SPECIAL USE <br />PERMIT. <br />WNEKEAs, an application has beenmade by Allen Lenz m permit operation ofa motorized scooter <br />business consisting of new and used sales, leasing, and repair of Accotors between 50ec she <br />300ce at the existing building located at 833 P ST SW, Suite #6, and <br />WBnREAs, the procedural history of the application is as follows: <br />1. An application for a Special Use Permit was received an April 28,2010, <br />2, The Planning Commission, purrumas to Published and mailed notices, held a public hearing <br />on May 18, 2010 and all present were given a chance to freely speak at the hearing. <br />3. The Planning Commission voted to recommend approval on May 18, 2010 subject to <br />conditions. <br />WBEREAN, the Planning Commission makes the following Findings of Pact with respect to the <br />Special Use Permit (SP2010-0U4): <br />1. The property is zoned I-1, Light Industrial. <br />2. The property is guided in the Comprehensive Plan for Light Industrial. <br />3. The applicant has proposed to operate a motorized scooter business consisting of new and <br />used sales, leasing, and repair of scooter between 50cc and 300x. <br />4. Zmming Code Sections 5-240 (6) & ('/) end "50 (2) indicate a Special Use Permit is <br />rex uired for an automotive servlees and sales use. <br />5. For the proposes of this review,scooter is being considered an automobile. <br />b. The Planning Commission reviewed the proposal is accordance with the following Special <br />Use Permit conditions of7musup Code Section 8430: <br />a. That the establishment mamm umoo, or operations of the Special use will not be <br />detrimemal to or endanger the public health, safety, morals, comfort or general welfare. <br />b. That the special use will not he injurious to the use mrd enjoyment of other property an <br />the immediate vicinity fm the purposes already parmitted, tar substantially di sh and <br />impair property values within the neighborhood. <br />c. That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding Properly for uses permitted in the <br />district <br />d. That adequate milifies, seems roads, drainage and/or necessary facilities have been or are <br />being provided. <br />e. That the special use shall in all other respects comonn to the applicable regulations of the <br />district In which it is located <br />S. The Planning Commission found all Special Use Permit salamis of Section 8-130 or be met <br />due m the following: <br />a. Adequate parking will be provided on site. <br />b.
