RESOLUTION <br />PLANNING COMMISSION <br />CITY OF NEW BRIGHTON <br />REWLVIION MAKING FMDMGS OF FACr AND RECOMMENOMO APPROVAL OF A SPECIAL USE <br />PERMIT. <br />WMERRAs, an application has been made by Jeff Van Iter Wal to permit construction of a 24' x <br />44' detached Wage whereby the total square footage would exceed 624 s.f. at 1,056 SF At 1847 <br />ISN AVE NW, and <br />WHEREAS, the procedural history of the application is as follows: <br />1. Ao application for a Special Use Permit was received on May 28, 2010. <br />2. The Pleooing Commission, pursuant to published end mailed notices, held a public hearing <br />on June 15, 2010 and all present were given a chance to freely speak az the hearing. <br />3. The Planning Commission rewmmwded approvalon June 15, 2010. <br />WHEREAS, the Planning Commission makes the following Findings of Fact with respect to me <br />Special Use Permit (SP20i0.005): <br />1. The property, is caned R-1, Single Family Residential. <br />2. The property is guided in the Comprehensive Plan for Low Density Residential. <br />3. 'Che property is legally described as follows: <br />Lot 9, Bieck 1, WINDWARD TERRACE, Ramsay County, Minnesota <br />4. The applicant has proposed to construct a 24' x 44' deuchN Wage whereby the square <br />tentage would exceed 624 square feet at 1,056 SF. <br />5. The Planning Commission considered the proposal in accordance with Z rung Cade Section <br />4-530 (1) (E) which requires approval of a Special Use Permit fix any accessory building in <br />excess of624 square f t. <br />6. The Planning Commission considered the proposed Special Use Permit in accordance with <br />Zoning Code Section 4-530 (1) (K) which requires tllaz the garage meet the following <br />conditions: <br />a. Roof and exterior color aM material most be consistent and complimentary with the <br />principal structure. <br />b. If deemed necessary by the City Council, landiderpe screening shall be provided to lessen <br />visual impact from adjacent properties. <br />c. No commercial or home occupation activity, shall be conducted within the accesawy <br />building. <br />7. The Planning Commission reviewed the proposal in accordance with the following Special <br />Use Permit conditions ofZoaing Cade Section 8-130: <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or mdsager the public bee th, safety, morula, comfort or general welfare. <br />b. That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already pemlitted, nor substantially diminish anal <br />impair property, values within the neighborhood <br />
