Approved <br />allow the Planning Commission and/or the City Council to review the criteria presented and make a <br />determination from there. Commissioner Zisla reiterated it is his opinion that the commission needs to <br />maintain the integrity of the process. <br />Motion by Commissioner Zisla seconded by Commissioner Schiferl, to close the Public Hearing. <br />Approved 6-0, the Public Hearing was closed. <br />Commissioner Nichols Matkaiti questioned the specific aspect of the variance requirements. City <br />Planner Gundlach responded her recommendation is that most of the valid hardships relate to the front <br />yard setback, and does not believe the pinching effect is a valid hardship inherent to the land, because <br />there are other options. Commissioner Zisla stated the commission has room to work with the applicant <br />to approve the requested variance. <br />Motion by Commissioner Zisla, seconded by Commissioner Nichols-Matkaiti to make a motion to <br />approve the front yard variance and the side yard variance of 4 feet, and the non -conforming use <br />City Planner Gundlach directed the commission to amend the findings of fact noted in the resolution. <br />Commissioner Zisla suggested the appropriate amendments. <br />Commissioner Schiferl questioned the reasonable use determination. Commissioner Zisla explained it is <br />a complicated issue, if there is a reasonable use on the property, the community can grant a variance. <br />Commissioner Schiferl suggested the City Attorney review the recommendation prior to the council <br />meeting. <br />Approved 6-0 <br />Adjournment: 8:34 PM <br />
