RESOLUTION NO. <br />10-037 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />MAKING FINDINGS OF FACT AND APPROVAL OF A SPECIAL USE PERMIT. <br />HE As, an application has been made by Allen Lenz to permit operation of a motorized <br />sc business business consisting of new and used sales, leasing, and repair of scooters between 50cc <br />and 3OOcc at the existing building located at 833 3rd ST SW, Suite #6, and <br />/HE AS, the procedural history of the application is as follows: <br />1. fm application for a Special Use Permit was received on April 28, 2010. <br />2. a Planning Commission, pursuant to published and mailed notices, held a public hearing <br />May 18, 2010 and all present were given a chance to freely speak at the hearing. <br />3. a Planning Commission voted to recommend approval on May 18, 2010 subject to <br />4. *e City Council considered the request on June 8, 2010. <br />/HE As, the Planning Commission and City Council make the following Findings of Fact with <br />respect to the Special Use Permit (SP2010-004): <br />1. e property is zoned I-1, Light Industrial. <br />2. e property is guided in the Comprehensive Plan for Light Industrial. <br />3. lhe applicant has proposed to operate a motorized scooter business consisting of new and <br />ed sales, leasing, and repair of scooter between 50cc and 300cc. <br />4. oning Code Sections 5-240 (6) & (7) and 6-050 (2) indicate a Special Use Permit is <br />.equired for an automotive services and sales use. <br />5. r the purposes of this review, scooter is being considered an automobile. <br />6. Ihe Planning Commission and City Council reviewed the proposal in accordance with the <br />llowing Special Use Permit conditions of Zoning Code Section 8-130: <br />That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />That adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br />That the special use shall in all other respects conform to the applicable regulations of the <br />district in which it is located. <br />8.
