<br />.,. <br /> <br />,~,.. <br /> <br />RESOLUTION No. 01-059 <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OFF ACT AND APPROVING LP 01-07, pun 01-01, AND R 01-02 . <br /> <br />WHEREAS, an application for a Site Plan, a Planned Unit Development and a Rezoning has been <br />i made by Main Street Village LLC and the City of New Brighton; and <br /> <br /> <br />WHEREAS, the procedural history ofthe application for the rezoning, site plan and PUD is as <br />follows: <br />1. <br />2. <br />3. <br />4. <br /> <br /> 5. <br /> 6. <br />I: 7. <br /> 8. <br /> <br />The City Council approved PUDOO.Ol(Phase I) and LPOO-6 on May 9, 2000; <br />The City Council approved PUDOO-Ol (Phase 2) and LPOO-7 on June 27, 2000; <br />The City Council approved PLOO-7 on August 22, 2000; <br />The City Council approved SPOI-07 regarding an Area of Special Control sign plan on <br />May 22, 2001 and, <br />The City Council approved LPOI-0S on May 22,2001. <br />An application for a Rezoning, Site Plan and PUD approval was filed with the City of <br />New Brighton on June 1,2001. <br />The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on June 19, 2001, and all persons present at the hearing were given an <br />opportunity to be heard. <br />The Planning Commission voted unanimously to recommend approval of the <br />Rezoning, the Planned Unit Development, a General Development Plan, and the Site <br />Plan on June 19,2001. <br /> <br />Now, THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Pact in <br />respect to PUD 01-01, R 01-02, and LP 01-07: <br /> <br />1. The subject site was zoned I-I, Light Industrial and 1-2, Heavy Industrial, and B~2, <br />Neighborhood Commercial and is hereby rezoned to B-4, Downtown Business. <br /> <br />2. The Main Street Village Site is located east of the 800 Line Railroad, west of 5th <br />Avenue NW, north of County Road E2 Extension, and south of Old Highway 8 NW. <br /> <br />3. The entire development area is roughly 10 acres in size and the residential component <br />is roughly 3 acres in size. <br /> <br />4. The subject site is also identified as the Brighton Corporate Park III site, part of a large <br />industrial park which the City began redeveloping in 1988. <br /> <br />5. The proposed PUD and Rezoning are both consistent with the City's Comprehensive <br />Plan provided the conditions stated here in are imposed. <br /> <br />6. The building and site design for proposed LP 01-07, are compatible with and <br />compliment surrounding land uses. <br /> <br />7. The approved Site Plan and Planned Unit Development as depicted in plans and <br />drawings entitled Main Street Housing, New Brighton Minnesota, prepared by BKV <br />
