• basis all necessary and appropriate gevemmental actions needed to redevelop the <br />Redevelopment Property, including but net limited to, those actions needed to. <br />complete the City Work; amend me City's comprehensive plan and the zoning <br />codes; acquire me Redevelopment Property; remediate adverse enviromnental <br />conditions on me Redevelopment Property; obtain fwds for acquisition of the <br />Redevelopment Property, environmental remediation and redevelopment; provide <br />public fmmrcinie and enter into redevelopment agreements for the planned <br />redevelopment wenn the Redevelopment Properly. <br />(b) The City shall (i) have the sole obligation and responsibility for the <br />redevelopment of the Redevelopment Property, bit enter into contracts for private <br />redevelopment, (iii) obtain financial assistance horn federal, nate, regional aal <br />local authorities to redevelop the Redevelopment Property, and (iv) determine <br />whether, avd to what reveal financial or site assembly assistance, including <br />authorizing the use ofeminers domain, will be necessary to induce redevelopment <br />of the Redevelopment Property. <br />(c) The City shall select,abroad and pay for fiscaVmx increment Wanting consultants, <br />appraisers, relocation specialists and attorneys regarding the redevelopment of the <br />Redevelopment Property. <br />(d) Provided that there are available resources, the City intends to acquire all of the <br />• Redevelopment Property by private purchase or eminent domain <br />(e) The City may allocate available tax moratoria to assist particular developments <br />within the Redevelopment Property in a manner which it deems appropriate to <br />promote we fullest development of the errcre Redevelopment Property. <br />Section 0.2 Diseretionary Actions. The Redeveloper acknowledges that many of the <br />actions to be taken by the City described in this Article and this Agreement call for the City to <br />act in its reasonable discretion or to exercise its legislative judgment. Such actions may only be <br />made following procedures established by the City w of the date hereof The Redeveloper <br />further acknowledges that under existing law, the City may not commit hereamder to make any <br />specific decisions on Panne legislative or discretiovary questions or decisions. <br />ARTICLE V <br />The Redeveloper and the City acknowledge that the Redevelopment Property may be <br />redeveloped in non-contiguous phases over a number of years. The redevelopment of the <br />Redevelopment Property, including one scope, nature and location of phased redevelopment will <br />be subject to such pennon as the City, in its reasonable judgment, deems consistent with the <br />master plan and marker condition, taking into consideration the following variables: timing; <br />• geographic areas within the Redevelopment Properly, the scope of necessary improvements; and <br />me type of development to lake place (for example, residential, commercial, or indumdal). <br />
