ived <br />PLANNING COMMISSION PROCEEDINGS <br />Regular Meeting — July 20, 2010 7:00 p.m. <br />Present: Commissioners Bruce Howard, James Alvey, Verne McPherson, Steve Danger, Paul Zisla <br />Norm Schiferl and Erin Nichols-Matkaiti <br />Absent: None <br />Also Present: Dave Jacobsen -Mayor, Janice Gundlach-City Planner, and Katie Bruno -Office Assistant. <br />Agenda Review: Chair Howard suggested City Planner Gundlach give an update on the City's <br />variance policy. The agenda was approved. <br />Minutes: Minutes from June 15, 2010 were presented and approved. <br />Council Action: Mayor Jacobsen reported the Council has been continuing to pursue opportunities for <br />the Northwest Quadrant with various developers, the major stumbling block remains to be financing. <br />City Manager Lotter is meeting with a representative from the Ramsey County Library Board to further <br />discuss library relocation into the Family Service Center. <br />Commissioner Nichols-Matkaiti asked Mayor Jacobsen if the Council has determined a winner for the <br />recent Northwest Quadrant renaming contest. City Planner Gundlach responded the council will review <br />the entries at a future work session. Mayor Jacobsen reported Council worksessions are primarily <br />focused on budget discussion, as the preliminary budget is to be presented in the fall. <br />Public Hearing: <br />(A) Jeff Van Der Wal requests consideration of a Special Use Permit to construct a 1,056 <br />SF detached garage at 1847 15th AVE NW. <br />City Planner Gundlach reported the Planning Commission did review this request at the June 15`h <br />meeting; action was tabled in order to have the applicant available for questions. The applicant is <br />requesting a Special Use Permit to allow construction of a 24' x 44' detached garage. The garage would <br />be located in the backyard, which is the southeast side of the property, and would be setback 50' from the <br />lake and 5' from the side lot line. All other setbacks on site are conforming. There is an existing shed <br />on the property that would be removed and there are no other detached buildings on the property. <br />City Planner Gundlach addressed the concerns presented at the June 15th meeting. <br />1. What are the storage needs of the Applicant: <br />The applicant provided a scaled drawing of his anticipated use for the accessory building. <br />2. Is there any merit to a covenant that restricts the construction of the building: <br />City Planner Gundlach stated it appears the covenants were apparently adopted when the plat was <br />done. If the covenants do exist; they are not enforced. It is not the City's role to enforce private <br />covenants; the commission's role is to base their determination on the Special Use requirements. <br />3. There was concern expressed at the size of the structure: <br />City Planner Gundlach reported the code allows for 30% of the lot to be covered with structure, in <br />this case the applicant would be at 17% based on the proposed structure. <br />City Planner Gundlach reported staff recommends approval subject to two conditions 1) The applicant <br />agrees not to conduct a home occupation the garage, and 2) That the exterior materials are <br />complimentary to the home. <br />
