<br />... <br /> <br />:! ." <br /> <br />.. - <br /> <br />RESOLUTION NO. <br /> <br />01-048 <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION AUTHORIZING THE CITY TO ENTER INTO AN <br />EASEMENT AGREEMENT WITH WILLIAMS PIPE LINE COMPANY, LLC <br /> <br />THE CITY COUNCIL OF THE CITY OF NEW BRIGHTON makes the following <br />Findings of Fact: <br /> <br />1. In January 2001, the City purchased two parcels of land from the Soo <br />Line Railroad (d/b/a the Canadian Pacific Railway) that are each 40 feet <br />wide and extend from First Street Northwest on the south to the County <br />Road E2 Extension to the north (the "Soo Line Strip"); <br /> <br />2. The Soo Line Strip is located within the MacGillis & Gibbs/Bell Lumber <br />and Pole Site (the "Site"), which the United States Environmental <br />Protection Agency ("EP A") placed on the National Priorities List <br />pursuant to Section 1 05 ofthe Comprehensive Environmental Response, <br />Compensation and Liability Act ("CERCLA", a/kIa The Superfund <br />Law). Similarly, the Minnesota Pollution Control Agency ("MPCA") <br />placed the Site on the State of Minnesota's Permanent List of Priorities <br />pursuant to the Minnesota Environmental Response and Liability Act; <br /> <br />3. The Site has been the subject of releases of hazardous substances, <br />pollutants and contaminants; <br /> <br />4. The Williams Pipe Line Company operates a pipeline that crosses the <br />Site including the Soo Line Strip; <br /> <br />5. The City finds that it is in the best interests of the health, safety and <br />welfare of City residents if the Williams pipeline were relocated to <br />facilitate the environmental clean-up Site. <br /> <br />6. Williams Pipe Line is willing to relocate its pipeline to facilitate the <br />environmental clean-up provided that it be granted a permanent <br />easement in which to operate its pipeline. A permanent easement would <br />replace the temporary revocable license agreement that Williams Pipe <br />Line had with the Soo Line Railroad. <br />
