<br />..~ .' <br /> <br />; ! <br />i I <br />! ! <br /> <br />~ <br /> <br />. , <br /> <br />I' <br />" <br /> <br />RESOLUTION No. 01-044 <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF SP 01 - 07 <br /> <br />WHEREAS, an application for a special use permit has been made by Stony Lake Properties, LLP to <br />", develop signage plans for Main Street Village. <br /> <br />Per Section 9-041, (3) of the New Brighton Zoning Ordinance, Special Use Permits for signs in a <br />renewal area; and <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for a special use permit was filed with the City of New Brighton on April 27, <br />2001. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on May 15, 200 I, and all persons present at the hearing were given an opportunity to be <br />heard. The Planning Commission considered the sign plans and unanimously recommended <br />approval subject to conditions (Vote: 6-0) <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in respect to <br />SP 01-07: <br />1. <br /> <br />2. <br /> <br />The subject site is zoned I-I, Light Industrial, 1-2, Heavy Industrial, and B-2, Neighborhood <br />Business. <br />The proposed sign plans include Project or district signs, building signs, and bracket signs <br />for light posts. <br />These signs consist of Building Address panels, Major tenant panels, awning graphics, and <br />bracket signs. <br />To date, the total signable area consists of 1,03 I square feet for existing buildings. Staffwill <br />determine additional signable area, and sign location for the entire PUD as future buildings <br />are constructed. <br />Staff will review proposed signs for any further phases of development, such as a residential <br />phase, for consistency and compliance with the established PUD and sign plans. <br />As specified in Section 9-041, standards for Areas of Special Control were considered; the <br />applicant was found to have met that the following: <br />a. That the sign plan provides sound identification, reduction of clutter, and <br />aesthetic enhancement. <br />b. That the sign plan is sensitive to and compatible with physical circumstances of the <br />site and buildings. <br />c. That the sign plan is not detrimental t3 public safety. <br />d. That the sign plan will not impede the normal and orderly placement of signs on <br />surrounding properties <br />As specified in Section 8-130 of the New Brighton Zoning Ordinance, no special use shall <br />be recommended by the Planning Commission unless such shall find: <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort of general public. <br />That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish <br />and impair property values within the neighborhood. <br />That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br /> <br />3. <br /> <br />4. <br /> <br />5. <br /> <br />6. <br /> <br />7. <br /> <br />b. <br /> <br />c. <br /> <br />1:ISHAREDICQUNC1LIRasofulions\2001\Comm.
