RESOLUTION NO. <br />10-063 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOoUTION MAKING FINDINGS OF FACT AND APPROVING A SITE PLAN AND SPECIAL USE PERMIT. <br />'HE EAS, an application has been made by Samir Elkhoury to permit redevelopment of 850 <br />Courjty Road D W, consisting of demolition of the existing building and construction of a <br />12, )115 SF multi -tenant commercial building, including a drive-thru facility, and <br />JHEOAS, the procedural history of the application is as follows: <br />1. applications for a Site Plan and Special Use Permit were received on September 3, 2010. <br />2. notice for public hearing was posed in the September 8, 2010 edition of the New Brighton <br />3. ablic hearing notices were mailed to the property owners within 350' of the subject property <br />iii September 10, 2010. <br />4.e Planning Commission held a public hearing on September 21, 2010 and all present were <br />t en a chance to freely speak at the hearing. <br />5. 'ihe Planning Commission recommended approval on September 21, 2010, subject to <br />6. Oe City Council considered the request on September 28, 2010. <br />SHE AS, the Planning Commission and City Council make the following Findings of Fact with <br />resp t to the Site Plan (LP2010-002) and Special Use Permit (SP2010-007): <br />1. e property is zoned B — 3, General Business. <br />2. e property is guided in the Comprehensive Plan for Community Business. <br />3. e Planning Commission and City Council considered the Site Plan in accordance with the <br />— 3 district standards of Section 5-250, the commercial performance standards of Section <br />390, and the parking standards of Chapter 11 of the Zoning Code. <br />4 he Planning Commission and City Council find all applicable Site Plan standards to be met. <br />5 he Planning Commission and City Council reviewed the proposed drive-thru in accordance <br />ith the following standards: <br />The drive-thru facility does not negatively impact traffic on public rights-of-way. <br />A stacking lane shall be provided with a minimum of four spaces per lane in addition to <br />the number of required parking spaces. <br />The stacking lane shall be a minimum of twelve feet wide. <br />41 The vehicle stacking lane shall not extend beyond the street right-of-way line. <br />The vehicle stacking lane shall be delineated so that vehicles waiting in line will not <br />unreasonably interfere with the primary driving, entrance, exit, and parking facilities on <br />site.
