1. !Implementation of the recommendations of the City Engineer, as noted in the Interoffice <br />Memo attached and Exhibit G and dated 9/15/2010. <br />2. A 5' parking lot setback is maintained along the side (west) lot line consistent with what is <br />depicted on the civil plans (but not the architectural plans). <br />3. The applicant attains any necessary temporary construction easements from the adjacent <br />ptindowner in order to realize the less than V side yard building setback as proposed. If <br />the applicant is not able to obtain necessary easements, the building footprint may be <br />pulled back 4 feet farther othe lot line at this location as described by the applicant at the <br />off ity Council meeting on September 28, 2010, without appearing before the Planning <br />0ommission and City Council for a Site Plan Amendment. <br />4. I The applicant submits a Lighting Plan at the time of building permit for review and <br />Tproval of the City Planner. This plan shall depict downward facing light fixtures and a <br />pot -candle measurement not to exceed .4 along the northern property boundary. <br />5. the applicant is required to obtain separate Sign Permits for permanent wall and ground <br />gns. Additionally, a Temporary Sign Permit will be required for any temporary sign <br />isplayed on the property. <br />6. A pedestrian crosswalk is included on the plans, delineating a safe route from the nine <br />irking spaces to the south of the drive-thru lane across the drive-thru lane. <br />7. ie revised Landscape Plan, as attached to the Council Memo dated 9/23/2010 as Exhibit <br />is implemented. <br />8.e applicant will ensure that adequate space exists for all users of the building for storage <br />d pickup of recyclable materials. <br />this 28th day of September, 2010. <br />ATS! <br />A.
