Response to nonconforming use permit standards.
1. We will be reducing the total of nonconformities as we will be make the rear setback
to the west of the property 5 feet as required. Also the front set back to the east is not
being met only because of the recent improvements to Silver Lake Road.
2. The nonconforming aisle between the parking stalls on the front or east side of the
building would be impractical to meet considering the parking requirements for the
center.
3. We have made all efforts that are seemingly practical to reduce the number of
nonconformities on the property. The parking lot to the east has been there we believe
since 1974 or so before the current owners bought the property and it coupled with the
retaining wall that is in place would not be practical to move since it does not have any
real impact on the adjoining property.
