Chairperson Howard questioned the commissioners as to their questions or concerns with the overlay <br />ordiannce. <br />Commissioner Nichols-Matkaiti reported she was concerned with the restrictions of hours of operations <br />in the event the berm is effective. Also, she suggested defining the hours of operations. <br />Commissioner McPherson suggested waiting to see if the mitigation is effective, there may not be a need <br />for the hours of operations. <br />Commissioner McPherson questioned if the license would be transferable to a new owner. Ms. Gundlach <br />responded typically every user must obtain their own license. <br />Commissioner Danger suggested removing the hours of operation requirement. <br />Commissioner Zisla questioned the relationship between the truck traffic and the crushing operation. Mr. <br />Murlowski stated that would be 65-70% during the week, and maybe 10% on the Saturdays. <br />Commissioner Schiferl stated there are tolerant species that could be planted on the berm, and suggested <br />the following be included in the aggregate crushing resolution: <br />Page 2 -number 6; In addition add "low maintenance." <br />And add 6.5 "In addition to help mitigate the potentially monolithic visually negative nature of the berm <br />while providing additional erosion control benefits, the applicant will plant and maintain clusters of <br />deciduous and evergreens shrubs and trees to be planted at intervals ranging from approximately 40-60 <br />feet with plant size and placement to be made in consultation with city staff and landscape consultant. <br />Commissioner Zisla questioned if the berm will be seen by many? Commisisoner Danger stated it seems <br />logical to plant on the sides of the berm, possibly wild flowers. <br />Ms. Gundlach stated she would work with the applicant once the commission recommends what they <br />would like to see in landscaping. <br />Chairperson Howard questioned the commission to their thoughts on the license versus Special Use <br />Permit. Commissioner Zisla stated he is in favor of the concept of the license, but not comfortable with <br />the lack of details. <br />Chairperson Howard noted that City Code review is not really a planning commission concern, and it <br />may be difficult to approve the license prior to knowing all the details. <br />Commissioner Nichols-Matkaiti expressed her concern with the City creating a license specific to one <br />business. <br />Chairperson Howard asked for additional comments. There were none. <br />Motion by Commissioner Zisla, seconded by Commissioner McPherson to close the Public <br />Hearing. <br />7 Ayes, 0 Nays, Motion Carried <br />The Public Hearing was closed at 9:11 pm. <br />Chairperson Howard suggested looking at the overlay district as the first item for consideration. <br />Commissioner Danger stated he was not ready to move forward on that item, because of the hours of <br />operations condition. Commissioner McPherson noted the construction of the berm is closely related to <br />the hours of operation. Commissioner Zisla suggested granting the condition and special use permit and <br />requires the berm to be built in a certain amount of time. <br />Ms. Gundlach suggested including the option for an extension of an additional 12 months if the applicant <br />is unable to complete berm. <br />Chairperson Howard suggested going through the Special Use Permits and license issue. Ms. Gundlach <br />stated that based on the discussion the commission is not supportive of the license requirement. <br />11 <br />
