Add the end of item #6 "In addition to help mitigate the potential monolithic visually negative nature of the berm, while proving additional erosion control benefits, the applicant will plant and maintain clusters of deciduous evergreen shrubs ands trees at intervals of 40-60 feet, to be made in consultation and approval of City Staff and/or a landscape consultant. Commissioner Zisla stated for the record he was in agreement with the concept, but expressed concern with the lack of specificity. The following amendments were recommended to the Special Use Permit: • Strike #1 OF of the third whereas paragraph. • Strike #1OH of the third whereas paragraph • Strike #3 of the therefore be it resolved paragraph • Strike #4 of the therefore be it resolved paragraph • Strike #6 of the therefore be it resolved paragraph • Carry over the same landscaping provisions to item #8 • Amend #9 to state at least 50% of the berm is constructed within 12 months of City Council approval, with the remainder of the berm being constructed within two years of City Council approval. • Add a condition requiring an annual inspection (within 30 days of July 15th ), along with up to three unannounced inspections per year. During these inspections City staff would be inspecting the site to ensure compliance with the approved plans that were submitted and attached to the planning report October 15th and September 16, 2010. (The following inspection criteria was noted; pile heights, volumes of yard waste, noise, maintenance of berm, dust mitigation and odor control.) 2
