RESOLUTION NO. 10-078 <br />City of New Brighton <br />County of Ramsey <br />State of Minnesota <br />RESOLUTION MAKING AN ELECTION NOT TO WAIVE THE STATUTORY <br />TORT LIMITS FOR LIABILITY INSURANCE PURPOSES <br />Minnesota Statutes Chapter 466 deals with tort liability for cities; and <br />Minnesota Statutes 466.04 currently sets the maximum liability limits for cities at <br />per claimant and $1,500,000 per occurrence; and <br />the City procures its insurance from the League of Minnesota Cities Insurance Trust <br />and <br />the City's current insurance policies provide coverage up to the tort liability limits as <br />by Minnesota Statutes; and <br />the LMCIT allows the City the option to waive those limits; and <br />, the LMCIT has required the City to make an election by resolution with regards to <br />or not waiving its tort liability established by Minnesota Statutes 466.04; and <br />No, Therefore Be It Resolved that: the City of New Brighton does hereby elect NOT to waive <br />the atutory tort liability limit established by Minnesota Statutes 466.04 <br />Adopted this 23rd day of November, 2010. <br />Attest:'_ <br />w <br />�i <br />1 <br />Daniel A.
