CITY OF NEW BRIGHTON <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br />RESOLUTION NO. 10-072 <br />A RESOLUTION TERMINATING THE NEW BRIGHTON <br />RAILROAD WYE PROJECT AND RELEASING GRANT FUNDS <br />j 1 WHEREAS, by Laws 2005, Chapter 20, Article 1, Section 18, Subdivision 6, the Minnesota <br />LOW= authorized a grant of 51,000,000 (the "Grant') for the construction of a rail line wye in <br />the (Pty, located at the southeast comer of the intersection between the Minnesota Commercial Rail <br />Lin and the Canadian Pacific Rail Line (the "New Brighton Wye Project'); and <br />!, WHEREAS, construction and operation of the New Brighton Wye would involve <br />coop ration and participation of the railroad companies with rail lines that would be connected by <br />the 4ive; and <br />I i WHEREAS, city staff has attempted to negotiate agreements with such railroad companies <br />to alw construction of the wye and connection to existing rail lines, and to provide for operation of <br />the a as an active railroad line; and <br />WHEREAS, it has become apparent from these efforts that it will not be possible to <br />to an agreement with such railroad companies that does not involve an ongoing and <br />sable financial cost to the taxpayers of the City; and <br />WHEREAS, the Council has determined that further efforts in pursuit of an acceptable <br />ted agreement with the railroad companies would not be fiuitful and is not a reasonable or <br />iate use of limited City staff resources; and <br />I WHEREAS, the Council finds that it is in the interest of the public and the taxpayers of the <br />City rid of the State that the State be notified that the City will no longer pursue the Grant and that <br />the $+ate is released from its commitment to provide funds for the New Brighton Wye Project. <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of New <br />n, Minnesota that: <br />1. The City Council hereby abandons the New Brighton Railroad Wye Project and <br />releases the Grant funds authorized by Minnesota Laws, 2005, Chapter 20, Article 1, <br />Section 18, Subdivision 6. <br />2.
