RESOLUTION NO. <br />10-069 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLUTION MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT. <br />, an application has been made by Murlowski Properties Inc to allow a yard waste <br />facility in an I-1, Light Industrial district per the requirements of the Environmental <br />ut Overlay Area located at 2200 Old Highway 8 NW, and <br />VHEAS, the procedural history of the application is as follows: <br />1. I n application for a Special Use Permit was received on September 3, 2010. <br />2. he Planning Commission, pursuant to published and mailed notices, held a public hearing <br />n September 21, 2010 and all present were given the chance to freely speak at the hearing. <br />3. t the September 21, 2010 meeting the Planning Commission continued the discussion to the <br />October 19, 2010 meeting. <br />4. t. he Planning Commission, pursuant to published and mailed notices, continued the public <br />hearing on October 19, 2010 and all present were given the change to freely speak at the <br />5.a Planning Commission recommended approval of the request subject to conditions. <br />6. e City Council considered the request on October 26, 2010. <br />s, the Planning Commission and City Council make the following Findings of Fact with <br />to the Special Use Permit (SP2010-009): <br />property is zoned I-1, Light Industrial. <br />2. Mhe property is guided in the Comprehensive Plan for Light Industrial. <br />3. ;e property is eligible to apply for uses under the Environmental Constraint Overlay Area. <br />4. a applicant has proposed to operate yard waste transfer facility at 2200 Old Highway <br />5. a Planning Commission and City Council considered the proposal in accordance with the <br />nvironmental Constraint Overlay Area criteria of Section 7-810(3). <br />6. he Planning Commission and City Council found the criteria of Section 7-810(3) are met, <br />bject to conditions. <br />7. Ihe Planning Commission and City Council reviewed the proposal in accordance with the <br />llowing additional Special Use Permit standards of Zoning Code Section 8-130: <br />That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />
