NWQ Maintenance Responsibilities <br /> Director Fernelius reported Staff has been working with the City Attorney on a mechanism for assessing <br /> the maintenance and capital replacement costs that will be charged in the NWQ. The plan would be to <br /> record a declaration against each property granting the City the right to annually assess the cost to <br /> property owners within the NWQ. Director Fernelius hopes to have Council review the item in spring of <br /> 2011. Staff is in the process of developing a budget. <br /> East Side Platting and Registration <br /> Director Fernelius reported Staff is also working on the platting registration of the east side of the NWQ. <br /> The platting process will start in March. As development occurs the City can subdivide the larger <br /> outlots into smaller parcels. The registration process will create clean title to the land and eliminate gaps <br /> and overlaps in legal descriptions. All of these logistical issues will make the site more development <br /> ready. <br /> Commissioner Benke reported MN DOT plans no longer require an additional right-of-way on I694. <br /> NW Refinery <br /> Director Fernelius reported there is no new information to report on the negotiations between the <br /> Attorney General's office, MPCA and Ashland Oil on an agreement concerning the clean-up of the <br /> former NW Refinery site. The City is now at a point where it is necessary to increase pressure on the <br /> parties to reach a settlement. Staff will work with the Mayor and other elected officials to put pressure <br /> on the MPCA to wrap up this agreement. <br /> Commissioner Smith noted Ashland Oil has been sold, and may be the reason for some of the delays. <br /> VII. Other Topics <br /> Foreclosure Update <br /> Director Fernelius reported there has been a movement to suspend foreclosures, as there are adverse <br /> effects if future foreclosures increase. Also reported was the adjacent communities; Columbia Heights <br /> and Fridley have far more residential foreclosures. <br /> Commissioner Benke questioned if the data is similar to 2008 and 2009, and if there are repeat <br /> foreclosures. Director Fernelius reported there were some; however not the majority. <br /> Commissioner Benke asked if the City has noticed any problems with foreclosures. Director Fernelius <br /> replied the majority of the problems are related to maintenance issues, and it can be difficult to <br /> determine who's responsible. <br /> Commissioner Smith questioned if there has been public comment at the City Council or Planning <br /> Commission meetings regarding the Stuart project. Councilmember Bauman and Director Fernelius <br /> both reported the meetings have been quiet. <br /> Commissioner Benke questioned the appointment of Advisory Commissioners for 2011. <br /> Councilmember Bauman reported council will consider making appointments in March. <br /> Adjournment <br /> Motion by Commissioner Benke,seconded by Commissioner Smith to adjourn the meeting. <br /> Meeting adjourned at 8:42 am. <br />
