Ms. Miranda stated she would have singers, and dances. <br /> Ms. Miranda also noted a closing time of 10:00 would greatly impact her business negatively. <br /> Ms. Mirnada also stated she does not intend to operate a night club. <br /> Councilmember Phillips suggested utilizing the State Building Code related to CFM air to <br /> regulate occupancy. City Planner Gundlach responded the Fire Marshal and Building Official <br /> will look at occupancy levels. City Attorney LeFevere clarified the CFM is a ventilation <br /> requirement, not an air conditioning requirement. <br /> Councilmember Phillips suggested differentiating hours of operation between public and <br /> private events. <br /> Councilmember Samuelson questioned how on-street parking will be prohibited. Ms. <br /> Gundlach stated the City will rely on complaints to determine if there is a problem. <br /> Councilmember Phillips questioned if the area will be signed"No parking."Director <br /> Jacobson reported if there is a problem, the police will likely be called. The Police will talk to <br /> the management of the business. <br /> Councilmember Burg stated she feels it is not acceptable to restrict parking on the City streets. <br /> City Planner Gundlach reported the parking is a concern if the restaurant,bar and event center are all full to <br /> capacity,and the likelihood of that happening are slim. <br /> Director Jacobson noted the applicant would have to apply for a 2:00 am closing license. <br /> Councilmember Bauman stated her disagreement with the later hours of operation, because of the close <br /> proximity to the residential area. <br /> Ms.Miranda reported closing at midnight Monday through Thursday will not be problematic for her. She <br /> anticipates Friday-Sunday being the peak times for Event Center reservations; and would like to apply for <br /> the 2:00 am closing license. <br /> Councilmember Phillips questioned if complaints can be dealt with through the liquor license. City Attorney <br /> LeFevere explained a liquor licenses does not cany any objective standard,and it can be difficult to define <br /> violations. <br /> Motion by Councilmember Phillips,seconded by Councilmember Burg to approve the <br /> Resolution,with 10 conditions, noting the following changes: <br /> (#9)The multi-functional area must honor the following hours of operation: <br /> a. Monday— Thursday: close no later 12 midnight & alcohol must not be served or <br /> brought into the event center after 11:00 pm. <br /> b. Friday — Sunday: close at the time permitted per the liquor license & alcohol <br /> must not be served or brought into the event center 1/2 hour prior to closing time. <br /> (#3)The posted occupancy load in the multi-purpose area must never exceed 267 and <br /> State Mechanical Code requirements for ventilation calculations must be met. <br /> Because of the potential for all three uses, multi-purpose/restaurant/bar areas, to <br /> interact occupancy loads in all three spaces must be posted based on the Fire <br /> Marshal's determination. <br /> (#5) Adequate parking must be provided on site for all patrons. <br /> 5 Ayes,0 Nays,Motion Carried <br />
