RESOLUTION No. 11-013 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />RESOLjUITION MAKING FINDINGS OF FACT AND APPROVAL OF A PRELIMINARY AND FINAL PLAT. <br />WHERT AS, an application has been made by Finn Daniels Architects on behalf of The Stuart <br />Company to be considered for a Preliminary and Final Plat for property located within the <br />Northwwest Quadrant on the west side of Old Highway 8 NW, currently known as Outlot B, <br />L0146 LAKE LANDING and Lot 1, Block 1, LONG LAKE LANDING, and <br />WHEOAS, the procedural history of the application is as follows: <br />P.i An application for a Preliminary and Final Plat was received by Finn Daniels Architects <br />on behalf of The Stuart Company on December 3, 2010. <br />�. Public hearing notices for the Preliminary and Final Plat were published in the New <br />Brighton Bulletin December 8, 2010. <br />.j Public hearing notification was distributed to all property owners within 600' of the <br />subject property on December 10, 2010. <br />�.� The Planning Commission, pursuant to published and mailed notices, held on a public <br />hearing on December 21, 2010. <br />�.I The Planning Commission recommended approval to the City Council for the <br />Preliminary and Final Plat on December 21, 2010. <br />i <br />8; The City Council considered the request on January 11, 2011 and January25, 2011. <br />s, the Planning Commission and City Council make the following Findings of Fact with <br />to the Preliminary Plat (PL2010-001) and Final Plat (FP2010-001): <br />The property is zoned NWQ, Northwest Quadrant. <br />The property is located in the area known as Tract 1 of the Northwest Quadrant, <br />exclusively on the west side of Old Highway 8 NW, known as Block H and <br />previously platted as LONG LAKE LANDING. <br />The existing legal descriptions of the properties included in the preliminary and <br />final plat requests are Outlots A, B, & C, LONG LAKE LANDING and Lot 1, <br />Block 1, LONG LAKE LANDING. <br />The proposed legal descriptions of the properties included in the preliminary and <br />final plat requests are Outlots A & B, THE VIEW APARTMENTS AT LONG <br />LAKE and Lot 1, Block 1, THE VIEW APARTMENTS AT LONG LAKE. <br />The Planning Commission held a public hearing on the preliminary and final plat <br />on December 21, 2010 and all persons were given the opportunity to be heard. <br />Section 26-33 of the City Code provides the following qualifications governing <br />approval of a preliminary plat: <br />A. The Planning Commission may return a conditional recommendation.
