<br />.~, . <br /> <br />RESOLUTION NO. 01-014 <br />CITY OF NEW BRIGHTON <br /> <br />RESOLUTION MAKING FINDINGS OF FACT AND RECOMMENDING APPROVAL OF SPOO-17. <br /> <br />WHEREAS, an application for a special use permit has been made by Independent School District <br />#621 to construct an addition to Highview Middle School, and expand/reconfigure the parking lot. Per <br />Section 4-030 ofthe New Brighton Zoning Ordinance, schools are a use allowed by special permit; and <br /> <br /> <br />WHEREAS, the procedural history of the application is as follows: <br />1. An application for a special use permit was filed with the City of New Brighton on <br />November 3,2000. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on November 21, 2000, and all persons present at the hearing were given an opportunity to <br />be heard. The item was continued to the January 16,2001 meeting. <br />3. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on January 16,2001, and all persons present at the hearing were given an opportunity to be <br />heard. <br />4. The City Council considered the proposal at its January 23,2001 meeting; and <br /> <br />Now THEREFORE BE IT RESOLVED, the City Council makes the following Findings of Fact in <br /> <br />,i respect to SPOO-17: <br />~ j <br /> <br />5. <br />6. <br /> <br />The subject site is zoned R-l, Single Family Residential. <br />The proposed additions consist of a new entryway, classrooms, a gym, media center and <br />expanded cafeteria. <br />Total building addition area consists of35,971 square feet. <br />As specified in Section 8-130 of the New Brighton Zoning Ordinance, no special use shall <br />be recommended by the Planning Commission unless such shall find: <br />a. That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort of general public. <br />That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish <br />and impair property values within the neighborhood. <br />That the establishment ofthe special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />That adequate utilities, access roads, drainage and/or necessary facilities have been or <br />are being provided. <br />That the special use shall, in all other respects, conform to the applicable regulations <br />of the district in which it located. <br />The proposed uses have been found to meet the above criteria. <br />The reconfigured parking area will include a "drop-off' area.
