RESOLUTION NO. <br />11-028 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT. <br />✓HEI*AS, an application has been made by Anna Miranda to permit operation of an event center <br />(also jtermed multi-purpose area, assembly hall, and/or dance hall) at 400 Old Highway 8 NW, <br />and <br />✓HM4AS, the procedural history of the application is as follows: <br />1. A1jn application for a Special Use Permit was received on January 28, 2011. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />February 15, 2011 and all present were given a chance to freely speak at the hearing. <br />3. ' e Planning Commission voted to recommend approval on February 15, 2011 subject to <br />4. Je City Council considered the request on February 22, 2011. <br />JHEI AS, the Planning Commission and City Council make the following Findings of Fact with <br />resp xt to the Special Use Permit (SP2011-002): <br />1. ' ie property is zoned B — 3, General Business which requires review and approval of a <br />ecial use permit for assembly halls and dances halls. <br />2. e property is guided in the Comprehensive Plan for Community Business. <br />3. a applicant has proposed to operate multi-purpose area consisting of live music <br />rforming, family shows, trade shows, and community meetings, and private events. <br />4. ming Code Section 5-240 (1) allows "amusement centers, recreation centers, armories, <br />embly halls, bowling alleys, dance halls, pool and billiards, theaters, skating rinks and <br />er social, sports, or recreation centers operated as businesses" by review and approval of a <br />ecial Use Permit. <br />5. ge Planning Commission and City Council reviewed the proposal in accordance with the <br />lowing Special Use Permit conditions of Zoning Code Section 8-130: <br />That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />That adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br />That the special use shall in all other respects conform to the applicable regulations of the <br />district in which it is located. <br />Development\2-22-2011\SP2011-002 (Miranda) - RESOLUTION (with Council change ).doc <br />1 <br />
