Approved <br /> PLANNING COMMISSION PROCEEDINGS <br /> Regular Meeting—March 15,2011 7:00 p.m. <br /> Present: Vice Chairperson Norm Schiferl Commissioners,James Alvey, Steve Danger,Paul Zisla,and <br /> Erin Nichols-Matkaiti <br /> Absent: Commissioners Bruce Howard and Verne McPherson <br /> Also Present: Janice Gundlach-City Planner,Mayor Jacobsen, and Katie Bruno-Office Assistant. <br /> Agenda Review: The agenda was presented and approved. <br /> Minutes: Minutes from February 15,2011 were presented and approved. <br /> Council Action: Mayor Jacobsen noted the council discussed term limits at a recent work session. <br /> Public Hearing: <br /> (A) Patrick Kinney requests consideration of a Special Use Permit to allow encroachment on the <br /> required 30' front yard setback for a front entryway addition at 2089 Mississippi Circle. <br /> The applicant requests a Special Use Permit to permit construction of a 6' x 12' front entry addition to <br /> the home at 2089 Mississippi Circle. The proposed front entry addition would encroach approximately <br /> 6' into the required 30' front yard setback, for a total front yard setback of 24'. Zoning Code Section 4- <br /> 040(3) (B)provides for a maximum encroachment of 35% of the width or the home or 12',whichever is <br /> less, when specified conditions are met. Staff has worked with the applicant to confirm that the <br /> submitted plans are in accordance with those conditions. The applicant is in the process of updating the <br /> home both interior and exterior. In conjunction with the covered front entry, the applicant intends to <br /> install new siding and a new roof. The exterior materials proposed for the entry will match the new <br /> siding and roof <br /> Zoning Code Section 4-040(3)(B) provides four conditions under which a Special Use Permit may be <br /> granted for an encroachment of the front yard setback for a covered front entry. Those conditions have <br /> been reviewed within the written report and staff finds the conditions have been met due to the following: <br /> • The proposed encroachment of the setback does not exceed 6' and the maximum width of <br /> the encroachment doesn't exceed 12'. <br /> • The proposed materials will match the home. <br /> • The roof is properly proportioned to&integrated with the existing roof <br /> • The base of the addition is not open in its appearance. <br /> Zoning Code Section 8-130 also requires review of the general health, safety&welfare standards. <br /> Staff provided a written analysis of these standards within the Planning Report and staff finds the criteria <br /> are met due to the following: <br /> .The roof addition and other associated exterior improvements will improve the neighborhood. <br /> .The front entry will not negatively impact use of other surrounding property nor will it impact property <br /> values. <br /> ■All other zoning standards are met. <br /> 1 <br />
