Approved <br /> Commission recommends approval of this request, it ought to be strictly conditioned to ensure the <br /> negative impacts that typically result with car sales businesses will not exist at this site. <br /> Zoning Code Section 8-130 establishes five general health, safety&welfare findings that must be met in <br /> order to approve a Special Use Permit. <br /> Staff provided a written analysis of those standards within the Planning Report & finds those standards <br /> are met based on the following: <br /> • Primary use will be office. <br /> • Exterior vehicle parking will be limited to 5 vehicles, which must be in good repair, <br /> operable,and have valid licenses. <br /> • Adequate parking exists on site. <br /> • The business should have little,if any,negative impacts on adjacent uses. <br /> • Typical car sales tactics won't be used, such as car display lots and signage on public <br /> roadways. <br /> 51 notices were sent to the neighbors within 350 feet of the property,no inquiries were received. <br /> Staff recommends the City Council approve the request, subject to the following conditions: <br /> • No more than 5 vehicles, in addition to employee or customer vehicles, are permitted on <br /> site during business hours. The applicant may only store a maximum of 5 vehicles on site <br /> outside business hours. <br /> • Any vehicles located on the property,whether advertised for sale or not, shall be operable, <br /> in good repair, and be properly licensed. <br /> • Inoperable vehicles may not be kept on site. <br /> • All vehicles must be located in designated parking stalls at all times. <br /> • Hours of operation shall be limited to Monday thru Friday, 9am to 5pm, Saturday by <br /> appointment only, &closed on Sunday. <br /> Commissioner Zisla questioned where the rules of limitations of operations are included. City Planner <br /> Gundlach noted the conditions limit the number of vehicles and condition of the vehicles. Commissioner <br /> Zisla suggested the description of the business is missing from the conditions. <br /> Commissioner Danger asked where"private sales" are addressed,to avoid the possibility of public sales. <br /> Ms. Gundlach suggested the commission could add a condition "Sales are limited to credit union <br /> members only." Ms. Gundlach noted the location is somewhat hidden, Commissioner Zisla suggested <br /> adding a condition to legally restrict certain activities. Schiferl suggested the following language be <br /> added; No exterior signage, and limiting the number of cars. Commissioner Zisla suggested following <br /> the state application requirements. Andy Bryce,representing CU Companies explained how credit union <br /> sales work, noting sales are typically done through credit union members. Commissioner Danger stated <br /> he is not opposed to the sales to the public, but would like the Special Use Permit language clarified. <br /> Schiferl suggested using the language used in the biannual sales permit. Ms. Gundlach noted that would <br /> not really be relevant,as there are many more than five cars at those particular sales events. <br /> Mr.Bryce commented that there would be no repairs or detailing completed at the site,strictly sales only. <br /> Ms. Gundlach suggested adding the following two conditions: <br /> • Exterior advertisements,including window signs are prohibited. <br /> • Any for-sale vehicles must be serviced off site. <br /> Vice Chair Schiferl asked for comments from the audience. <br /> Kevin Vendex, representing Trend Enterprises expressed his gratitude to the City for their thoroughness. Mr. <br /> Vendex stated he supports the commissions point to protect from any future tenants. <br /> Commissioner Danger questioned the process if more than the five allotted parking stalls are full. Mr. Bryce <br /> commented that he drives one of the cars that are for sale; and noted the likelihood of having 5 cars for sale at one <br /> time is very small. Additionally the property management company has indicated they would have seven stalls if <br /> needed. <br /> 3 <br />
