10. The Planning Commission and City Council reviewed the proposal in accordance with the <br /> following Special Use Permit conditions of Zoning Code Section 8-130: <br /> a. That the establishment,maintenance,or operations of the special use will not be <br /> detrimental to or endanger the public health,safety,morals, comfort or general welfare. <br /> b. That the special use will not be injurious to the use and enjoyment of other property in <br /> the immediate vicinity for the purposes already permitted,nor substantially diminish and <br /> impair property values within the neighborhood. <br /> c. That the establishment of the special use will not impede the normal and orderly <br /> development and improvement of the surrounding property for uses permitted in the <br /> district. <br /> d. That adequate utilities,access roads,drainage and/or necessary facilities have been or are <br /> being provided. <br /> e. That the special use shall in all other respects conform to the applicable regulations of the <br /> district in which it is located. <br /> 11. The Planning Commission and City Council determined that all special use conditions of <br /> Section 8-130 have been met as outlined in the Planning Report dated April 15,2011. <br /> Now THEREFORE BE IT RESOLVED, that based upon the above findings of fact the application <br /> for a Special Use Permit(SP2011-006)is approved, subject to the following condition: <br /> 1. A 48 SF sign shall be permitted for the corner tenant of Building E only when that corner <br /> tenant occupies more than one tenant space/suite, specifically occupying suites 104, 105,and <br /> 107 as illustrated on the suite layout provided. <br /> Adopted this 26th day of April,2011. <br /> Dave Jacobsen, Mayor <br /> A 1TEST: Dean R.
