RESOLUTION NO. <br />11-043 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />MAKING FINDINGS OF FACT AND APPROVING A SPECIAL USE PERMIT. <br />THE AS, an application has been made by Andy Bryce on behalf of Automotive Resources, Inc <br />and PU Companies to permit operation of automotive sales at the existing building located at <br />877 ,3rd ST SW, Suite #6, and <br />✓HEI*AS, the procedural history of the application is as follows: <br />1. �'n application for a Special Use Permit was received on February 25, 2011. <br />2. The Planning Commission, pursuant to published and mailed notices, held a public hearing <br />q March 15, 2011 and all present were given a chance to freely speak at the hearing. <br />3. Planning Commission voted to recommend approval on March 15, 2011 subject to seven <br />4. The City Council removed the item from their agenda on March 22, 2011 to allow for further <br />discussion at a work session. <br />5. $tall provided written notice to the applicant extending the 60 -day review deadline an <br />glditional 60 days to June 25, 2011. <br />6. te <br />e City Council held a work session on April 5, 2011 and discussed the applicant's request. <br />7. City Council considered the item at their regular meeting of April 12, 2011. <br />VHEI AS, the Planning Commission and City Council make the following Findings of Fact with <br />resp t to the Special Use Permit (SP2011-004): <br />1. e property is zoned I-1, Light Industrial. <br />2. Tie property is guided in the Comprehensive Plan for Light Industrial. <br />3. e applicant is proposing to operate an automotive sales use consisting of office space and <br />eping of no more than 5 vehicles for sale on site at any given time. <br />4. ning Code Sections 5-240 (6) and 6-050 (2) indicate a Special Use Permit is required for <br />automotive sales use. <br />e Planning Commission and City Council reviewed the proposal in accordance with the <br />lowing Special Use Permit conditions of Zoning Code Section 8-130: <br />That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />That adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br />11Cormnunity Development\April 12, 2011\SP2011-004 (Bryce) - RESOLUTIONAd <br />
