RESOLUTION NO. <br />11-051 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />LAKING FINDINGS OF FACT AND APPROVAL OF A SPECIAL USE PERMIT. <br />application has been made by Vicki Van Dale to permit operation of a doggie day <br />at the existing building located at 1561 Old Highway 8 NW, and <br />S, the procedural history of the application is as follows: <br />application for a Special Use Permit was received on April 1, 2011. <br />2. Oe Planning Commission, pursuant to published and mailed notices, held a public hearing <br />on April 19, 2011 and all present were given a chance to freely speak at the hearing. <br />3. 'oe Planning Commission voted to recommend approval on April 19, 2011 subject to <br />4. Te City Council considered the request on April 26, 2011. <br />/HE AS, the Planning Commission and City Council make the following Findings of Fact with <br />respct to the Special Use Permit (SP2011-008): <br />1. Ie property is zoned MX, Mixed Use. <br />2. 1te property is guided in the Comprehensive Plan for MU, Mixed Use. <br />3. a applicant has proposed to operate a doggie day care business, including ancillary retail <br />les, overnight boarding, grooming, and training. <br />4. Z ning Code Section 6-050(2) allows approval of any use through Special Use Permit within <br />e I-1, Light Industrial, so long as the use is neither residential nor deemed heavy. <br />5. a Planning Commission and City Council reviewed the proposal in accordance with the <br />llowing Special Use Permit conditions of Zoning Code Section 8-130: <br />! That the establishment, maintenance, or operations of the special use will not be <br />detrimental to or endanger the public health, safety, morals, comfort or general welfare. <br />That the special use will not be injurious to the use and enjoyment of other property in <br />the immediate vicinity for the purposes already permitted, nor substantially diminish and <br />impair property values within the neighborhood. <br />That the establishment of the special use will not impede the normal and orderly <br />development and improvement of the surrounding property for uses permitted in the <br />district. <br />That adequate utilities, access roads, drainage and/or necessary facilities have been or are <br />being provided. <br />.i That the special use shall in all other respects conform to the applicable regulations of the <br />district in which it is located. <br />6. a Planning Commission and City Council found all Special Use Permit criteria of Section <br />130 to be met due to the following: <br />The nearest adjacent use in over 200' away. <br />4.
