Arne Cook suggested in fairness both groups should be given the option to renegotiate, <br /> noting this could lengthen the decision making process. <br /> Arne Cook stated the financial records have not been requested from either Ryan or Opus, noting both <br /> firms have had financials issues, stating there is a risk with either company. Director Fernelius stated <br /> Opus has been more direct with city staff regarding their financial condition and records. <br /> Mr. Cook stated that it would be best for the EDC to make a recommendation sooner, rather than ask for <br /> renegotiations. The consensus of the commission was to recommend Ryan. <br /> Motion by Commissioner Beach, seconded by Commissioner Smith that the EDC recommend to <br /> the Council that Ryan be designated as developer for the NWQ; now known as New Brighton <br /> Exchange. <br /> 7 Ayes -0 Nays Motion carried. <br /> Chairperson Benke suggested any correspondence be directed to Director Fernelius. Mr. Cook <br /> suggested adding a contingency to both agreements. <br /> Northwest Quadrant Report <br /> Director Fernelius reported the City Council has officially adopted New Brighton Exchange as the new <br /> name for the Northwest Quadrant. The new name will be an important part of the marketing effort. <br /> Staff plans to work with appropriate advisors on providing copyright protection for the new name and <br /> logo. <br /> The View Apartment Project <br /> Efforts are continuing with the Stuart Companies apartment project. In the last couple of weeks the <br /> sides have been working on a side agreement to address the buyer's concerns about a title matter. The <br /> developer has until April 26th to complete its due diligence work. In the meantime, the City is working <br /> with the developer and their lender to better understand the environmental history. The company plans <br /> to close in mid-May and break ground by July 1st. Councilmember Phillips commented it is possible <br /> Block G and tract 2 could have a similar issue. Director Fernelius reported the legal counsel advised <br /> the City to wait and see. Commissioner Beach questioned if the ground breaking could be pre-empted. <br /> Director Fernelius responded the ground breaking will take place as planned. <br /> Report from Council Liaison <br /> Councilmember Phillips reported the Council recently directed staff to continue discussions regarding <br /> the Clearwire tower constructed at Freedom Park. <br /> The Council had a question and answer period during the recent Town Hall meeting. Councilmember <br /> Phillips reported he would like to provide an opportunity for residents to address the council prior to the <br /> start of a regular council meeting. Councilmember Phillips reported the Ramsey County Board has <br /> determined the new library will be called the New Brighton Library. <br /> Director Fernelius expressed his gratitude to Commissioners Benke and Flahave for their many years of <br /> valuable service. <br /> Adjournment <br /> Motion by Commissioner Benke, seconded by Commissioner Smith to adjourn the meeting. <br /> Meeting adjourned at 8:57 am. <br />
