Approved <br /> Staff considered the proposed use in accordance with the special use standards of Section 8-130. <br /> In summary, we find the standards are met based on the following: <br /> • The technical information provided indicates very low emissions, no odors, and no <br /> discernable smoke. <br /> • The site is located in a primarily industrial neighborhood, with the nearest residence being <br /> 330' to the north, which is separated by a railroad. <br /> • Pets can be dropped off indoors if necessary. <br /> • On-site parking is adequate to support the proposed use. <br /> • All other zoning district standards are met. <br /> 13 notices were sent out, 5 inquiries expressing opposition were received. The following concerns were <br /> expressed by the public: <br /> • Odors, emissions, and general environmental concerns <br /> • "not in my backyard" <br /> • Lowering of property value because of proximity to crematory <br /> • Too close to residential uses &parks <br /> • Traffic <br /> • Parking <br /> Staffs general thoughts with regard to public concerns include: <br /> • Any denial has to be based on a tangible negative impact to the public. <br /> • Emissions will be regulated by the MPCA, which are low enough that a permit won't be <br /> required. <br /> • Odors will be prohibited through the Special Use Permit. <br /> • The railroad provides a buffer to the nearest residential uses. <br /> • Nearest park is 800' — 1000' away. <br /> • Traffic and parking will be much less than what could occur with many of the permitted <br /> industrial uses (like warehousing and manufacturing). <br /> • Inquiries to other Cities that have cremation uses indicate no problems. <br /> • It's also important to note that this use was previously approved at a different location, <br /> which was adjacent to residential uses. <br /> Staff recommends the City Council approve the request, subject to the following ten conditions : <br /> • Site plan is developed in accordance with the submitted survey. <br /> • The parking lot area lying within the 40' front yard setback is removed. <br /> • The Landscape Plan is implemented as proposed. <br /> • The Special Use Permit shall permit pet cremation only, which allows ancillary retail sale <br /> of cremation/memorial products for pets. <br /> • All State and County air emissions & environmental permits that are applicable are <br /> obtained& submitted to the City in conjunction with the required building, mechanical, <br /> and electrical permits. <br /> • The Building Official & Fire Marshall inspect the facility following installation of the <br /> retort&prior to opening for business. <br /> • Only one retort/cremation machine is permitted on site. <br /> • Unclaimed ashes are disposed of in a lawful manner. <br /> • No odors from the operation are detectable at the property line. <br /> 3 <br />
