Worksession Item <br /> 14°P1) <br /> CITY OF NEW BR.IGHTOT <br /> COMMUNITY DEVELOPMENT DEPARTMENT <br /> MEMORANDUM <br /> DATE: June 8, 2011 <br /> TO: Dean Lotter, City Mana•'-', <br /> FROM: Grant Fernelius, Communi Development Director <br /> SUBJECT: June 13th Clearwire Tower Discussion (Closed Session) <br /> As we discussed last week, staff and the city attorney will be provide an update to the <br /> City Council on the status of the Clearwire tower in Freedom Park. After several <br /> meetings and conference calls with the company over the last six months, the parties <br /> have been unable to reach agreement on a solution. The City is now in a position of <br /> either leaving the tower in place or pursuing legal remedies to try and remove it. <br /> Given the likelihood of potential litigation, staff and the city attorney are recommending <br /> that the Council conduct a portion of the work session in closed session pursuant to <br /> Minnesota Statutes 13D. The city attorney will advise Council on the appropriate steps <br /> to take to close the meeting and then review the City's legal options. <br /> cc: Janice Gundlach <br /> Charlie LeFevere <br />
