RESOLUTION NO. <br />11-060 <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF NEW BRIGHTON <br />MAKING FINDINGS OF FACT AND APPROVING A PLANNED RESIDENTIAL <br />T AMENDMENT. <br />WHEREAS, an application for an amendment to an existing Planned Residential <br />,elopment has been made by SilverCrest Properties LLC to allow construction of a 33 <br />wall sign at Meadowood Shores located at 2100 Silver Lake Road, said sign to be <br />;ted on the building fapade facing Silver Lake Road, and <br />WHEREAS, the procedural history of the application is as follows: <br />An application for a Planned Residential Development Amendment was made on <br />April 29, 2011. <br />The Planning Commission, pursuant to published and mailed notices, held a public <br />hearing on May 17`h and all persons present were given an opportunity to be heard. <br />The Planning Commission recommended the City Council approve the request, <br />subject to conditions. <br />The City Council considered the request on May 24, 2011. <br />WHEREAS, the Planning Commission and City Council make the following Findings <br />Tact with respect to the Planned Residential Development Amendment (RD201 1 -001): <br />The property is located at 2100 Silver Lake Road. <br />The property is zoned B — 3, General Business. <br />The property is guided in the New Brighton Comprehensive Plan for CB, Community <br />Business. <br />The property previously received Planned Residential Development and Site Plan <br />approval on April 28, 1998 per Resolution 98-048. <br />The proposed amendment would allow for erection of a 33 SF wall sign on the Silver <br />Lake Road building frontage, when Chapter 9 Zoning Code standards would normally <br />allow a sign on the 27`h AVE NW fagade as that is the side with legal street frontage. <br />Per the PRD Amendment review criteria of Zoning Code Section 7-110, the PRD <br />standards of Section 7-060 were considered and it was determined none of those <br />standards would be impacted by the proposal to erect a 33 SF sign. <br />Per the PRD Amendment review criteria of Section 7-110, the Planning Commission <br />and City Council also considered whether or not the proposal would be in <br />conformance with the stated principals of Zoning Code Section 7-070(2)(A — G). The <br />Planning Commission and City Council found the proposal to meet these criteria <br />based on the following findings: <br />a. The proposed sign will be placed on the Silver Lake Road frontage, rather <br />than the 27`h AVE NW frontage where the property has street frontage and <br />
