RESOLUTION NO. 11-087
STATE OF MINNESOTA
COUNTY OF RAMSEY
CITY OF NEW BRIGHTON
RESOt,UTION MAKING FINDINGS OF FACT AND APPROVING A SITE PLAN REQUEST.
WHEREAS, an application has been made by Peter Murlowski to allow installation of a third
driveway curb cut/access point at 1901 Sioux Boulevard per Zoning Code Section 11-020 (8) (G)
requires Site Plan approval for more than two access points, and
/HE *AS, the procedural history of the application is as follows:
1. n application for a Site Plan was received on August 30, 2011.
2.]10 public hearing is required.
i
3. — a Planning Commission voted to recommend conditional approval on September 20, 2011.
4. TIhe City Council considered the request on September 27, 2011.
RHE AS, the Planning Commission and City Council make the following Findings of Fact with
resp t to the requested Site Plan (LP2011-001):
1. e property is zoned R-1, Single Family Residential.
2, e property is guided in the Comprehensive Plan for Low Density Residential.
3. the applicant proposes to install a horseshoe driveway, which will require installation of a
1rd driveway curb cut/access point.
4. Dning Code Section 11-020 (8) (G) states that no property under common ownership and
ed as a single unified use shall be entitled to more than two curb cuts or access points
less a site plan or site plan amendment for a greater number is approved by the City
5. '" a Planning Commission considered the following factors in making a recommendation to
prove the request:
Sight visibility will not be negatively impacted and likely will improve around the corner
of Kiowa Avenue and Sioux Boulevard.
The horseshoe driveway will provide some additional parking and alleviate the need to
j regularly park vehicles in the existing driveway, which is almost entirely in the public
I right-of-way.
The required driveway setback standards can be met.
jThe applicant has stated that the 50% maximum impervious surface coverage standard
will be met.
THEREFORE BE IT RESOLVED, that based upon the above Findings of Fact the City
ncil herby grants approval of the Site Plan request, subject to the following conditions:
stallation of the horseshoe driveway shall be in compliance with the 50% maximum
rdcover limitation for the entire parcel.
le two new driveway access points shall meet the following requirements:
20' setback from any right-of-way line of a street intersection.
40' setback from another driveway on the same parcel.
50' setback from another driveway on a different parcel.
Driveways shall intersect the street at a 90 degree angle.
1\Community Development\9-27-201 I\LP2011-001 (Murlowski) - KESOLUTION.doc
