Approved <br /> Norm Wells, the applicant commented that the current landscaping is pretty well in place, and there is not <br /> a great area to be landscaped. It was noted that two mature ash trees were removed as part of the first <br /> addition. Chairperson Howard asked if additional tress and shrubs can be added. Mr. Wells commented <br /> that space is an issue, but if space is available they would add the requested trees. Planner Gundlach <br /> suggested making the corners of the foundation planting areas larger. <br /> Commissioner Meyers questioned if Bell Pole is expanding its staff. Mr. Wells responded that the <br /> addition would allow office space for key sales people, as some are currently working for home. <br /> Commissioner Nichols-Matkaiti asked if the canopy tree would be problematic. Mr. Wells stated that an <br /> additional canopy tree could be a problem, as many varieties don't do well in New Brighton. <br /> Commissioner Shardlow questioned whether there is a viable solution to the odor problems. City <br /> Planner Gundlach stated that the City worked with Bell Pole about five years ago on an odor mitigation <br /> plan. The City is fairly confident that odors emanating from the stack are at a non-detect level. What <br /> was not tested was the existing treated poles that are off gassing outdoors on site. Planner Gundlach <br /> suggested maybe the treated poles injected with chemicals may be problematic with regard to odors in <br /> certain weather/wind conditions. <br /> Chairperson Howard asked the commissioners if they are comfortable approving the item, or would they <br /> like to table the item. <br /> Commissioner Shardlow stated he would feel comfortable approving, given the long term relationship <br /> the city has shared with the applicant. Commissioner Nichols-Matkaiti stated that because options may <br /> not be practical, we should not table at this time. Commissioner Danger stated that any results may take <br /> longer than one month. <br /> Motion by Commissioner McPherson, seconded by Commissioner Danger to close the Public Hearing. <br /> 7-0 Motion carried <br /> The Public Hearing was closed at 7:42 p.m. <br /> Commissioner Danger stated that while he likes to see businesses progress, he is uncomfortable with the <br /> number of non-conformities, and the fact that the applicant has not conformed in the past. <br /> City Planner Gundlach addressed the parking and storage being less than the required setback. An aerial <br /> photo was displayed, noting that if setbacks are implemented, the area of usable property is greatly <br /> reduced, it has been determined by past actions of the City Council that that is an impractical standard to <br /> impose. <br /> The City continues to look at possible reasons for the odor. <br /> Regarding the lack of concrete curbing and drive aisles; the expense associated with paving is deemed <br /> impractical. The fence height and location issue was approved in 1984 in order to address another non <br /> conformity. <br /> City Planner Gundlach explained that a Non-conforming Use Permit does allow non-conformities to exist <br /> and expand. Chairperson Howard noted staffs recommendation addresses some of the non conformities <br /> on the site. <br /> City Planner Gundlach explained that most non conformities on the site pre date the Zoning Code. <br /> Commissioner Danger commented that he wants to be sure all applicants are treated fairly. <br /> Motion by Commissioner McPherson, seconded by Commissioner Shardlow to approve staff <br /> recommendation . <br /> 7-0 Motion carried <br /> 4 <br />
